Justice R.BASANT\n\n Dated :01\/12\/2007\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n              Crl.M.C.Nos.3311,3312 &amp; 676 of 2007\n                    ----------------------------------------\n             Dated this the 1st day of December 2007\n\n                               O R D E R\n<\/pre>\n<p>      These Criminal Miscellaneous Cases are filed by the second<\/p>\n<p>accused in C.C.Nos.146\/02, 568\/02 and 569\/02 all pending<\/p>\n<p>before the Judicial First Class Magistrate Court-II, Ernakulam.<\/p>\n<p>All these are prosecutions under Section 138 of the Negotiable<\/p>\n<p>Instruments Act and they have all been initiated by the same<\/p>\n<p>complainant, that is the respondent herein.<\/p>\n<p>      2.   Altogether there are two accused persons in these<\/p>\n<p>three prosecutions. The first accused in all the three cases is the<\/p>\n<p>husband of the common petitioner herein. The petitioner is the<\/p>\n<p>first accused.\n<\/p>\n<p>      3.   The short contention raised by the learned counsel for<\/p>\n<p>the petitioner in all these three cases is that though she is the<\/p>\n<p>wife of the first accused, she is not the account holder nor is she<\/p>\n<p>a signatory to the cheques concerned. The learned counsel for<\/p>\n<p>the petitioner contends that under Section 138 of the Negotiable<\/p>\n<p>Instruments Act, the liability is only on the drawer of the cheque<\/p>\n<p>and the holder of the account in which the cheque is issued.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.Nos.3311,3312 and 676\/07    2<\/span><\/p>\n<p>Inasmuch as the petitioner is neither the account holder nor a<\/p>\n<p>signatory to the cheque, the petitioner is not liable to face these<\/p>\n<p>prosecutions. The mere fact that the petitioner may also be<\/p>\n<p>liable to discharge the original liability, will not in any way make<\/p>\n<p>her answerable to a charge under Section 138 of the Negotiable<\/p>\n<p>Instruments Act, contends the learned counsel for the petitioner.<\/p>\n<p>      4.    The      learned      counsel  for    the    respondent,<\/p>\n<p>Sri.P.K.Mohammed           fairly concedes that it is true that the<\/p>\n<p>petitioner herein, the second accused in all the three cases is<\/p>\n<p>neither the account holder nor the drawer of the cheques<\/p>\n<p>concerned. In these circumstances, the learned counsel fairly<\/p>\n<p>concedes that these prosecutions in so far as they relate to the<\/p>\n<p>petitioner\/second accused, can be quashed invoking the powers<\/p>\n<p>under Section 482 Cr.P.C.\n<\/p>\n<p>      5.    The request of the petitioner in these petitions is<\/p>\n<p>hence accepted.         C.C.Nos. 146\/02, 568\/02 and 569\/02 all<\/p>\n<p>pending before the Judicial First Class Magistrate Court-II,<\/p>\n<p>Ernakulam, in so far as they relate to the petitioner\/second<\/p>\n<p>accused, are hereby quashed.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.Nos.3311,3312 and 676\/07   3<\/span><\/p>\n<p>      6.    The learned counsel for the respondent\/complainant<\/p>\n<p>submits that some errors have been committed in the production<\/p>\n<p>of the documents in these cases. There is an error in producing<\/p>\n<p>the documents. He prays that the respondent may be permitted<\/p>\n<p>to make appropriate applications to take back the cheque in one<\/p>\n<p>case and produce them in the other.\n<\/p>\n<p>      7.    Appropriate application can be made before the<\/p>\n<p>learned Magistrate.
