\nInsofar as the   appeliant was<\/p>\n

unexpected,   circumstance that this was so, could<\/p>\n
   to attribute contributory negligence to the<\/p>\n
  the appellant had been pmceeding at :-1 sedate<\/p>\n
  Litiexpeeted event of an axle telling ell’ the vehicle<\/p>\n

negligence in a case such as this and therefore, there was no<\/p>\n

contentions, the amount of uompensation iaw.ai1_ied’ uriidef<\/p>\n
heads is certainly on the lower  and  <\/p>\n
enhancement, having due regartliiiiaihiitlie l’zui:itai_
\nand material on record. ‘  ttiiitarlls pain and
\nsuftisring is etitteeafxjged, the…he_ad  is towards m.m..\n<\/p>\n
pecuniary    the discretion of the<\/p>\n
Tribunal to await} i\u00e9guzns on  lassessmeng the same ought to<\/p>\n
wnliumiito similaf’a}wa1’ds in identical  Ifthe nature of<\/p>\n
the injuries iiazfeiiL’\u00bbs,)nii:e_rr4ii:~\/ti;  amount ought to have been larger.<\/p>\n
  :ny~l’\u00abopiiiim_1, thei”ap\u00a71e!\u00ablant would be entitled to additional sum<\/p>\n
  towards pain and sulliaring.\n<\/p>\n
 lnsc3’t’a iWas the claim towards miscellaneous expenditure during
\n”   of treatment and eonxialeseenee is concerned; the
\n  ilitilbunai has awarded only Rs.3000f-. The same ought to be<\/p>\n
“iienhaneed by atleast a sum ot’Rs.7000r’- towards transport and<\/p>\n

relevant multiplier are applied, the appellant would be entitled to
\na sum of Rs.2,l8,880\/- that is rounded oil’ to Rs.2,.l”9,D0Of~<\/p>\n

After deducting a sum of Rs.25,()00:’-, the  J<\/p>\n
entitled toRa.l.,94,000\/’- underthis  t <\/p>\n
Insofar as the dedueiion ‘t;.xii’t”w-M9131′  V  of<\/p>\n
compensation on the fo1)tingt’iiiitl:at  vviais’ etmtributory
\nnegligence on the part of   sustained. The<\/p>\n
manner in which ‘:z_<:eidentii':a.s occurred would clearly indicate<\/p>\n
that there _l'i(.'rv diiiigenee, on the part of the appellant<\/p>\n
   rnennler in i\\iri'\\I'lr'i'\u20ac.'.'.'l"i'itl2(.$ accident has occurred has taken the<\/p>\n
 by surprise, as it would any other person<\/p>\n
in i  plaee; "fheretom, it cannot be said that there was<\/p>\n
'eontxibtitoiEy negligence on the part of the appellant. The<\/p>\n
  of 25% of the compensation amount is not warranted.<\/p>\n
 appeal is accordingly allowed in terms as above. The<\/p>\n
