DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>RULE.\n<\/p>\n<p>\tLearned APP waives service of notice of Rule for the respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.53\/2005 with Amreli City Police Station, Amreli for the<br \/>\n\toffences punishable u\/s. 324, 323, 504, 147, 148, 149, 325, 326 and<br \/>\n\t435 of Indian Penal Code and u\/s. 135 of the Bombay Police Act.\n<\/p>\n<p>Learned<br \/>\n\tCounsel appearing for the applicant submits that<br \/>\n\tdue to a liver ailment, the applicant was admitted in Sterling<br \/>\n\tHospital, Surat as an indoor patient.  Later on the wife of the<br \/>\n\tapplicant delivered a child and the father<br \/>\n\tof the applicant also expired.  In the above circumstances, the<br \/>\n\tapplicant could not comply with the conditions of the bail and the<br \/>\n\tlearned Sessions Judge, Amreli issued a non-bailable warrant.  It is<br \/>\n\tfurther submitted that the applicant would file an Undertaking<br \/>\n\tbefore the Trial Court that he would attend the hearing of the case,<br \/>\n\tas required, unless so exempted by the Trial Court without any<br \/>\n\tdefault and in the above circumstances, of filing an Undertaking by<br \/>\n\tthe applicant as stated above, the applicant  may be enlarged<br \/>\n\ton bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.53\/2005 with<br \/>\n\tAmreli City Police Station, Amreli on executing a bond of Rs.5,000\/-<br \/>\n\t(Rupees Five Thousand Only) with one surety of the like amount to<br \/>\n\tthe satisfaction of the Trial Court and subject to the conditions<br \/>\n\tthat he shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tfile an Undertaking before the<br \/>\n\tTrial Court that he would attend the hearing of the case, as<br \/>\n\trequired, unless so exempted by the Trial Court without any default;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
