JUSTICE HARSHA DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/07\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nthis application under section 439(2) read with section 482 of the<br \/>\nCode of Criminal Procedure, 1973, the applicant &#8211; State of<br \/>\nGujarat has challenged the order dated 25th April, 2011<br \/>\npassed by the 3rd Additional Sessions Judge, Jamnagar<br \/>\nwhereby he had enlarged the respondent accused on bail in relation to<br \/>\nthe offence punishable under sections 406, 409, 420, 464, 465, 468,<br \/>\n471 and 120B of the Indian Penal Code.\n<\/p>\n<p>2.\t\tMs.\n<\/p>\n<p>C.M. Shah, learned Additional Public Prosecutor for the applicant has<br \/>\nassailed the impugned order by submitting that the respondent herein<br \/>\nis the main accused in the matter and that the learned Judge without<br \/>\nconsidering the gravity of the offence has erred in granting bail in<br \/>\nfavour of the respondent.  It is submitted that in the circumstances,<br \/>\nthe impugned order granting bail is required to be set aside and the<br \/>\nbail granted to the respondent is required to be cancelled.\n<\/p>\n<p>3.\t\tA<br \/>\nperusal of the impugned order passed by the learned Additional<br \/>\nSessions Judge indicates that the learned Judge has applied his mind<br \/>\nto all the relevant factors and has found that the respondent accused<br \/>\nis not a hardened criminal.  Considering the record of the case, the<br \/>\nlearned Judge has found that the documents have been recovered by the<br \/>\npolice during the course of investigation and that the FIR is based<br \/>\nmainly on documentary evidence and as such, there is no possibility<br \/>\nof tampering with the evidence.  The learned Judge has further<br \/>\nconsidered the nature of the offence and has, after considering the<br \/>\nrelevant decisions in this regard, found that this is a fit case for<br \/>\ngrant of bail.\n<\/p>\n<p>4.\t\tHaving<br \/>\nperused the impugned order, this Court is of the view that the<br \/>\nlearned Judge vide the impugned order, has enlarged the respondent on<br \/>\nbail after taking into consideration all relevant parameters in this<br \/>\nregard.
