Ashok Paswan vs State Of Bihar on 30 November, 2010<\/div>\n
              IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        CR. APP (SJ) No.809 of 2010\n                            ASHOK PASWAN\n                                  Versus\n                            STATE OF BIHAR\n                                 -----------\n<\/pre>\n
03.   30.11. 2010           Heard the bail prayer of the appellant after<\/p>\n
                    receipt of the L.C.R. The appellant stands convicted<\/p>\n
                    under Section 22(b) of the N.D.P.S. Act and<\/p>\n
                    sentenced to R.I. for seven years and fine of<\/p>\n
                    Rs.10,000\/-.\n<\/p>\n
                            The allegation and evidence is that 50 gms<\/p>\n
                    of heroin was recovered from the possession of the<\/p>\n
                    appellant.\n<\/p>\n
                            Learned counsel for the appellant submits<\/p>\n
                    that the small quantity of heroin is 5 gms and the<\/p>\n
                    commercial quantity is of 250 gms as per the table in<\/p>\n
                    the N.D.P.S. Act. It is submitted that the quantity<\/p>\n
                    was much below the commercial quantity. Learned<\/p>\n
                    counsel also submits that punishment for small<\/p>\n
                    quantity is six months only. Learned counsel also<\/p>\n
                    submits that the appellant is in custody since<\/p>\n
                    07.08.2006 and thus he has completed four years and<\/p>\n
                    four months of incarceration.\n<\/p>\n
                            In the circumstances, I do not feel inclined
\n                          2<\/span><\/p>\n
       to allow bail to the appellant for the present. Hence,<\/p>\n
       bail prayer of the appellant is refused. However, if so<\/p>\n
       advised, the appellant may renew his prayer for bail<\/p>\n
       after completion of five years of incarceration if the<\/p>\n
       appeal is not heard within the period.<\/p>\n
