Injection Norditropin was prescribed for<br \/>\ntreatment.  The claim of the respondent for reimbursement of<br \/>\nthe medical  expenses  incurred\t on  purchase  of  the\tsaid<br \/>\ninjection to the tune of Rs.  3,13,200\/- was rejected by the<br \/>\nappellant Board.    The\t respondent, thereupon, filed a writ<br \/>\npetition seeking a direction for reimbursement of  the\tsaid<br \/>\namount with  interest  in the High Court.  The writ petition<br \/>\nwas resisted primarily on the ground that the policy of\t the<br \/>\nBoard was not to reimburse expenses on &#8220;imported medicines&#8221;.\n<\/p>\n<p>\tThe High Court noticed that the drug in question was<br \/>\nnot  available\tin  India  and that the same was an imported<br \/>\ndrug.  The High Court, however, allowed\t the  writ  petition<br \/>\nobserving  that\t the  respondent&#8217;s son had a serious problem<br \/>\nand that since the imported drug had been duly prescribed by<br \/>\nthe  doctor  at\t the  Post  Graduate  Institute\t of  Medical<br \/>\nSciences,  Chandigarh  the  respondent\twas  entitled  to be<br \/>\nreimbursed for\tthe  expenses  incurred\t in  purchasing\t the<br \/>\nimported drug.\tThe Bench observed:\n<\/p>\n<blockquote><p>\t\t&#8220;In  fact,  instances  are not lacking were<br \/>\n\t   people have gone abroad for\ttreatment  and\tthe<br \/>\n\t   expenses have  been\tpaid by the State.  Surely,<br \/>\n\t   if a particular medicine  is\t not  available\t in<br \/>\n\t   India  and  has to be imported, nobody can help.<br \/>\n\t   A poor patient has to import\t the  medicine\tand<br \/>\n\t   take it.  This is precisely what appears to have<br \/>\n\t   happened in\tthe present case.  Still further no<br \/>\n\t   reason  whatsoever  has  been  advanced  in\tthe<br \/>\n\t   written statement to indicate as to why a person<br \/>\n\t   is  not  entitled  to  reimbursement of expenses<br \/>\n\t   incurred by him on  account\tof  the\t import\t of<br \/>\n\t   medicine.   It can be imagined that if a drug is<br \/>\n\t   available in India and yet a person\tchooses\t to<br \/>\n\t   import  a  particular  medicine and spends money<br \/>\n\t   which is avoidable, the competent authority\tmay<br \/>\n\t   take\t the  view that no re-imbursement should be<br \/>\n\t   allowed or that it should  be  confined  to\tthe<br \/>\n\t   expense which the patient would have incurred on<br \/>\n\t   getting the\tdrug  within the country.  However,<br \/>\n\t   it is not even suggested  in\t the  present  case<br \/>\n\t   that the  drug is available in India.  In such a<br \/>\n\t   situation, it appears fair to assume\t that  this<br \/>\n\t   life saving drug had to be imported.\t That being<br \/>\n\t   so,\tthere  would  be  no  reasonable  basis for<br \/>\n\t   declining to reimburse the expenses.&#8221;\n<\/p><\/blockquote>\n<p>\tAggrieved by the direction issued by the High  Court<br \/>\nto  re-imburse\tthe amount together with interest, the Board<br \/>\nis in appeal by special leave.\n<\/p>\n<p>\tWe have heard learned counsel for  the\tparties\t and<br \/>\nexamined the record.\n<\/p>\n<p>\tIt  is\tan  admitted  case  of\tthe parties that the<br \/>\npolicy of the Government  of  India,  which  has  also\tbeen<br \/>\nadopted by the Govt.  of Punjab and the Board, is that where<br \/>\nthe  drugs manufactured in India have proved ineffective and<br \/>\nthe prescription  of  some  imported  life  saving  drug  is<br \/>\nimperative for &#8220;saving the life of the patient&#8221;, such a drug<br \/>\ncan  be\t prescribed  and  the  patient\tcan procure the same<br \/>\neither\tby  placing  an\t order\twith  the  foreign  firm  or<br \/>\notherwise  and\twhen  that  is\tdone  and the certificate is<br \/>\nissued by the Chief Medical Officer of the  District\/Medical<br \/>\nSuperintendent\tof  the\t hospital  to  the effect that he is<br \/>\nsatisfied that the drug in question is considered absolutely<br \/>\nessential to &#8220;save the life of the  patient&#8221;,  reimbursement<br \/>\nof  costs  of  the  drug,  excluding  the packaging charges,<br \/>\ncustoms duty from charges etc.\tis permissible.\t   The\tHigh<br \/>\nCourt,\thowever,  appears  to  have assumed that the drug in<br \/>\nquestion was a &#8220;life saving drug&#8221;.  The\t certificate  issued<br \/>\nby   the   Post\t Graduate  Institute  of  Medical  Sciences,<br \/>\nChandigarh which is available on  the  record  at  page\t 32,<br \/>\nshows\tthat  the  disease  was\t not  life  threatening\t and<br \/>\nNorditropin injection is &#8220;not a\t life  saving  drug&#8221;.\t The<br \/>\nsubmission  of learned counsel for the respondent that since<br \/>\nthe son of the\trespondent  was\t suffering  from  a  chronic<br \/>\ndisease,  he  was  entitled  to reimbursement of the medical<br \/>\nexpenses including the expenses\t incurred  on  the  imported<br \/>\nmedicine  on  the  basis  of the instructions dated 1.1.1991<br \/>\ndoes not appear to be correct.\tA  careful  perusal  of\t the<br \/>\ninstructions  dated  1.1.91 shows that it only lists certain<br \/>\nchronic diseases, the treatment for which can be done either<br \/>\nas an out-door patient i.e.  without being admitted  in\t the<br \/>\nhospital or  by\t admission  in the hospital.  Vide para 2 of<br \/>\nthose instructions, no reimbursement limit has been fixed as<br \/>\nan out-door patient for the employees and pensioners of\t the<br \/>\nState Governments.    These  general  instructions, however,<br \/>\nhave  to  be  read  along  with\t the  specific\tinstructions<br \/>\ncontained  in  the  Government\tof  India instructions dated<br \/>\n21.7.1972 and the instructions issued by the Board  in\t1997<br \/>\ndeclaring  as  a  policy  of the Board that reimbursement of<br \/>\nimported drug shall be permitted  only\twhere  the  imported<br \/>\ndrug is a &#8220;life saving drug&#8221;.  It becomes obvious from joint<br \/>\nreading\t of  various instructions (supra) that reimbursement<br \/>\nof the drugs, whether imported by  the\tpatient\t himself  or<br \/>\npurchased  from\t a  chemist who has imported those drugs, is<br \/>\npermissible only where the imported drug  is  considered  as<br \/>\nabsolutely essential  to &#8220;save the life of the patient&#8221;.  It<br \/>\nis not in dispute that the drug in  question  was  essential<br \/>\nfor &#8220;saving  the  life of the patient&#8221;.\t That the disease of<br \/>\nthe patient was a &#8220;chronic disease&#8221; does not  mean  that  it<br \/>\nwas   &#8220;life   threatening&#8221;   in\t  view\tof  the\t unambiguous<br \/>\ncertificate issued by the PGI, as referred to  above.\t The<br \/>\nBoard  was,  therefore,\t perfectly justified on the basis of<br \/>\ninstructions referred to above and its policy  decision,  to<br \/>\ndecline\t to  reimburse\tthe medical expenses incurred on the<br \/>\npurchase of the imported drug Norditropin, being not a &#8220;life<br \/>\nsaving drug&#8221;.  Since, the High\tCourt  wrongly\tassumed\t the<br \/>\ndrug  to be a &#8220;life saving drug&#8221; it clearly fell in error in<br \/>\nissuing the direction for reimbursement of the amount.\t The<br \/>\njudgment of the High Court under the circumstances cannot be<br \/>\nsustained.\n<\/p>\n<p>\tThis appeal, therefore, succeeds and is allowed. The<br \/>\njudgment of the High Court is set aside. The writ  petition,<br \/>\nfiled before the High Court shall stand dismissed.
