Justice ANTONY DOMINIC\n\n Dated :07\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                W.P.(C) NO. 27692 OF 2010 (J)\n                =====================\n\n         Dated this the 7th day of September, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>      Although the petitioners admit that they are occupants of<\/p>\n<p>road puramboke and are carrying on petty trades, relying on<\/p>\n<p>Ext.P3 judgment in OP NO.5798\/93, petitioners contend that their<\/p>\n<p>eviction can only be in compliance with the provisions of the Land<\/p>\n<p>Conservancy Act and only after issuing a notice under Section 11<\/p>\n<p>of the said Act. It is contended that without complying with the<\/p>\n<p>said directions, Ext.P4 series of notices have been issued calling<\/p>\n<p>upon the petitioners to vacate from the places occupied by them<\/p>\n<p>within 7 days. It is these notices which are under challenge.<\/p>\n<p>      2.   I heard the learned counsel for the petitioners and also<\/p>\n<p>the learned Government Pleader appearing for the respondents.<\/p>\n<p>      3.   It is an undisputed fact that in Ext.P3 judgment<\/p>\n<p>rendered by this Court in OP NO.5798\/93 filed by the petitioners,<\/p>\n<p>it has been directed that their eviction can only be after notice to<\/p>\n<p>them as per Section 11(3) of the Land Conservancy Act. This<\/p>\n<p>requirement does not appear to have been complied with, and if<\/p>\n<p>that be so, proceedings initiated by Ext.P4 series of notices<\/p>\n<p>WPC No. 27692\/10<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>cannot be sustained.\n<\/p>\n<p>     4.    Be that as it may, having regard to the directions in<\/p>\n<p>Ext.P3 judgment rendered as above, it is directed that Ext.P4<\/p>\n<p>series of notices be treated as notices in compliance with the<\/p>\n<p>directions in Ext.P3 judgment. It will be open to the petitioners to<\/p>\n<p>file their objections to Ext.P4 series of notices to the 2nd<\/p>\n<p>respondent within 15 days from today.        If the petitioners file<\/p>\n<p>replies as above, the 2nd respondent will hear them and pass final<\/p>\n<p>orders in the matter, which shall be done at any rate within 4<\/p>\n<p>weeks of the petitioners filing their objections. In the meanwhile,<\/p>\n<p>it is directed that dispossession pursuant to Ext.P4 series of<\/p>\n<p>notices will be suspended.\n<\/p>\n<p>     5.
