No.1851\/2005\n               ----------------------------------------------\n                  Dated 22nd September, 2009.\n\n                               O R D E R\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>           This is a review petition at the instance of the<\/p>\n<p>appellants. The Writ Appeal was dismissed. The issue pertains to<\/p>\n<p>the claim made by the respondent\/writ petitioner for the third<\/p>\n<p>higher grade. In the writ petition, it is brought to our notice that<\/p>\n<p>the essential grievance of the writ petitioner was regarding the<\/p>\n<p>junior drawing a higher pay, whereas the direction given by the<\/p>\n<p>learned Single Judge was to grant the third higher grade. The<\/p>\n<p>fact remains that the writ petitioner has been promoted to the<\/p>\n<p>post of Skilled Assistant Grade II and he has undergone a change<\/p>\n<p>in the scale of pay twice in the said post. However, as far as the<\/p>\n<p>incumbents covered by Exts.P8 and P9 are concerned, they are<\/p>\n<p>directly recruited to the post of Skilled Assistant Grade II and they<\/p>\n<p>have been granted three time bound grade promotions on<\/p>\n<p>account of the stagnation in the scale of pay. In that process,<\/p>\n<p>though juniors, they have been drawing a higher scale of pay<\/p>\n<p>than that of the writ petitioner. That under law is impermissible,<\/p>\n<p>and the latest ruling of the Apex Court on that point is reported in<\/p>\n<p><span class=\"hidden_text\">RP NO.277\/09                     2<\/span><\/p>\n<p><a href=\"\/doc\/1960367\/\">Gurcharan Singh Grewal v. Punjab State Electricity Board<\/p>\n<p>and others<\/a> [(2009)3 SCC 94].
