             Kulbhushan Lal Chopra-petitioner has filed this petition<\/p>\n
under Section 482 of the Code of Criminal Procedure primarily<\/p>\n
seeking a direction to respondent Nos. 2 to 5 to register FIR against<\/p>\n
respondent Nos. 6 to 9 under Section 420 of the Code of Criminal<\/p>\n
Procedure.\n<\/p>\n
             It has been held by the Apex Court in Sakiri Vasu vs.<\/p>\n
State of U.P. and others<\/a>, 2008 (1) RCR (Criminal) 392 as under:-<\/p>\n
             “24. In view of the above mentioned legal position, we are<\/p>\n
             of the view that although Section 156(3) is very briefly<\/p>\n
             worded, there is an implied power in the Magistrate under<\/p>\n
             Section 156(3) Cr.P.C. to order registration of a criminal<\/p>\n
             offence and\/or to direct the officer in charge of the
\n Crl. Misc. No. M- 12339 of 2009 (O&M)               -2-\n<\/p><\/blockquote>\n
concerned police station to hold a proper investigation<\/p>\n
and take all such necessary steps that may be necessary<\/p>\n
for ensuring a proper investigation including monitoring<\/p>\n
the same.    Even though these powers have not been<\/p>\n
expressly mentioned in Section 156(3) Cr.P.C., we are of<\/p>\n
the opinion that they are implied in the above provision.<\/p>\n
25.We have elaborated on the above matter because we<\/p>\n
  often find that when some one has a grievance that his<\/p>\n
  FIR has not been registered at the police station and\/or<\/p>\n
  a proper investigation is not being done by the police,<\/p>\n
  he rushes to the High Court to file a writ petition or a<\/p>\n
  petition under Section 482 Cr.P.C. We are of the<\/p>\n
  opinion that the High Court should not encourage this<\/p>\n
  practice and should ordinarily refuse to interfere in such<\/p>\n
  matters, and relagate the petitioner to his alternating<\/p>\n
  remedy, firstly under Section 154 (3) and Section 36<\/p>\n
  Cr.P.C. before the concerned police officers and if that<\/p>\n
  is of no avail, by approaching the concerned Magistrate<\/p>\n
  under Section 156 (3).\n<\/p>\n
26. If a person has a grievance that his FIR has not been<\/p>\n
  registered by the police station his first remedy is to<\/p>\n
  approach the Superintendent of Police under Section<\/p>\n
  154 (3) Cr.P.C. or other police officer referred to in<\/p>\n
  Section   36   Cr.P.C.   If   despite   approaching     the<\/p>\n
  Superintendent of Police or the officer referred to in<\/p>\n
  Section 36 his grievance still persists, then he can<\/p>\n
  approach a Magistrate under Section 156 (3) Cr.P.C.\n<\/p>\n
               Crl. Misc. No. M- 12339 of 2009 (O&M)               -3-<\/p>\n
              instead of rushing to the High Court by way of a writ<\/p>\n
              petition or a petition under Section 482 Cr.P.C.<\/p>\n
              Moreover he has a further remedy of filing a criminal<\/p>\n
              complaint under Section 200 Cr.P.C. Why then should<\/p>\n
              writ petitions or Section 482 petitions be entertained<\/p>\n
              when there are so many alternative remedies ?”<\/p>\n
            Since,   the   petitioner   has   sought   a   direction    for<\/p>\n
registration of FIR, this petition is dismissed.<\/p>\n
            The petitioner,     if   so advised,    may approach        the<\/p>\n
Magistrate under Section 156 (3) Cr.P.C.<\/p>\n
