JUSTICE BIRENDRA PRASAD\n                            VERMA\n                 ORAL ORDER<\/pre>\n<p>                 (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>3   21-07-2011           The petitioner, a candidate for appointment to the Higher<\/p>\n<p>                 Judicial service, has challenged the result of the Preliminary<\/p>\n<p>                 Examination published by the Bihar State Public Service<\/p>\n<p>                 Commission on the ground that the questions the petitioner had<\/p>\n<p>                 answered correctly were marked wrong on account of wrong<\/p>\n<p>                 answer key submitted by the paper setters. Two of the questions,<br \/>\n<span class=\"hidden_text\">          Patna High Court CWJC No.10867 of 2011 (3) dt.21-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                     2<\/span><\/p>\n<p>                      question nos. 46 and 52, in the subject of General Studies Booklet<\/p>\n<p>                      Series-C were correctly answered by the petitioner as can be<\/p>\n<p>                      ascertained from the standard text book. However, the answers<\/p>\n<p>                      given in the answer key were wrong, thereby the petitioner has lost<\/p>\n<p>                      two marks pushing him below the cut off marks. Had those<\/p>\n<p>                      questions been examined correctly, the petitioner would have<\/p>\n<p>                      obtained two more mark and he would have been considered<\/p>\n<p>                      eligible to take the competitive examination.<\/p>\n<p>                              The examination in question had been conducted by the<\/p>\n<p>                      Bihar Public Service Commission for recruitment and selection for<\/p>\n<p>                      the posts in Subordinate Judicial Service of the State of Bihar.<\/p>\n<p>                      While exercising power of judicial review under Article 226 of the<\/p>\n<p>                      Constitution, this Court will not venture to examine each answer<\/p>\n<p>                      paper nor would this Court examine the correctness of the answer<\/p>\n<p>                      key given by the Expert. If we intend to interfere, we must direct<\/p>\n<p>                      to alter the answer key and then to re-examine each answer sheet.<\/p>\n<p>                      This is evidently beyond the jurisdiction of this Court more<\/p>\n<p>                      particularly in view of the belated challenge in the present writ<\/p>\n<p>                      petition.\n<\/p>\n<p>                              For the aforesaid reasons the petition is dismissed in limine.<\/p>\n<pre>\n\n\n                                                    (R.M.
