This Appeal under Clause 10 of the Letters<br \/>\n                   Patent arises from the judgment and order dated<br \/>\n                   02.07.2010 passed by the learned single Judge in above<br \/>\n                   CWJC No. 5383 of 2010.\n<\/p>\n<p>                              The appellant-writ petitioner is the Secretary of<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>Pandit Ujjwal Kumar Mishra Foundation. The said<br \/>\nFoundation runs and manages a High School in the name<br \/>\nof Pandit Ujjwal Kumar Mishra High School at Dhanauti<br \/>\nMarai, Hajipur, District Vaishali.\n<\/p>\n<p>          The school was established in the year 2000 but<br \/>\ncould not be accorded recognition as it did not satisfy all<br \/>\nthe parameters. While the application of the school was<br \/>\npending    consideration,    on      19.05.2009      the   State<br \/>\nGovernment took a policy decision of not granting<br \/>\naffiliation \/ recognition to any non-government unaided<br \/>\nschool. On account of the said policy, the application of<br \/>\nthe appellant for recognition \/ affiliation has been rejected.<br \/>\nThe challenge before the learned single Judge has failed,<br \/>\ntherefore, the present Appeal.\n<\/p>\n<p>          Learned Advocate Mr Mahendra Thakur has<br \/>\nappeared for the appellant. He has submitted that the<br \/>\nschool was established in the year 2000. It answered all<br \/>\nthe parameters except the question of land. That question<br \/>\nwas also resolved in the year 2008.           The appellant,<br \/>\ntherefore, applied for according recognition in the year<br \/>\n2008. That was not granted and it was refused on account<br \/>\nof the fact that in 2009 the Government had taken a policy<br \/>\ndecision not to grant affiliation to such schools.\n<\/p>\n<p>          Mr Thakur has submitted that the policy<br \/>\ndecision dated 19.05.2009 could not have been applied to<br \/>\nthe appellant&#8217;s school which was established long before<br \/>\nthat date and it answered all the parameters in the year<br \/>\n2008. The policy decision could be applied prospectively<br \/>\nand not retrospectively.\n<\/p>\n<p><span class=\"hidden_text\">                           3<\/span><\/p>\n<p>                  We are not impressed by the argument of Mr<br \/>\n        Thakur. The policy decision is indeed prospective.       In<br \/>\n        view of the policy decision, since 19.05.2009 no affiliation<br \/>\n        \/ recognition can be accorded to any non-government<br \/>\n        unaided school. The learned single Judge has rightly<br \/>\n        rejected the Writ Petition. No case for interference is made<br \/>\n        out.\n<\/p>\n<p>                  The Appeal is dismissed in limine.\n<\/p>\n<p>                  Interlocutory Application (I.A.
