JUSTICE GOPAL PRASAD<\/p>\n<p>Gopal Prasad, J.                  Heard learned counsel for the appellants and<\/p>\n<p>                        learned counsel for the State.\n<\/p>\n<p>                                  2. The appellants have been convicted for offence<\/p>\n<p>                        under Section 395 of the Indian Penal Code sentenced to<\/p>\n<p>                        undergo rigorous imprisonment for seven years.<\/p>\n<p>                                  3. Learned counsel for the appellants however,<br \/>\n<span class=\"hidden_text\">               2<\/span><\/p>\n<p>contends that this is a case of dacoity in the night of 06.<\/p>\n<p>01. 1995, while the informant along with his family<\/p>\n<p>members were sleeping in the house 20-25 persons open<\/p>\n<p>the tatti fence and entered into Angan and committed<\/p>\n<p>dacoity.       Seven persons have been named in the<\/p>\n<p>Fardbeyan on the basis of which F.I.R. was lodged and<\/p>\n<p>after investigation charge sheet submitted. However, only<\/p>\n<p>two out of seven named in the F.I.R. were charge sheeted<\/p>\n<p>and other were not sent up. Two persons Madan Mohan<\/p>\n<p>and Bhobha @ Manglu showing in the column &#8216;not sent<\/p>\n<p>up&#8217;.\n<\/p>\n<p>           4. During investigation, some suspects were<\/p>\n<p>arrested and put on Test Identification Parade in which<\/p>\n<p>some of them were identified by the informant.<\/p>\n<p>Subsequently, charge sheet submitted.\n<\/p>\n<p>           5. However, during trial eleven witnesses were<\/p>\n<p>examined as witnesses. Out of which P.W. 9 and 11 are<\/p>\n<p>Judicial Magistrates who conducted Test Identification<\/p>\n<p>Parade. P.W. 10 is I.O.\n<\/p>\n<p>           6. However, P.W. 9 and 11 has stated that in Test<\/p>\n<p>Identification Parade, appellant no. 1 and 2 identified by<\/p>\n<p>five witnesses and appellant no. 3 and 4 identified by two<br \/>\n<span class=\"hidden_text\">              3<\/span><\/p>\n<p>persons. However, during trial, P.W. 9 and 11 the Judicial<\/p>\n<p>Magistrates who conducted Test Identification Parade has<\/p>\n<p>proved that five witnesses have identified each of the<\/p>\n<p>appellant nos. 1 and 2 and two witnesses have identified<\/p>\n<p>appellant nos. 3 and 4 each.\n<\/p>\n<p>         7. However, witnesses 1 to 8 who are material<\/p>\n<p>witnesses do not identify the accused persons in the court.<\/p>\n<p>Witnesses 1         and 7 have been declared hostile by<\/p>\n<p>prosecution. However, P.W. 8 the informant, though, not<\/p>\n<p>declared hostile but has not identified the accused persons<\/p>\n<p>in Court. Accused Gera Mian, though, named in<\/p>\n<p>Fardbeyan was not identified in the Test Identification<\/p>\n<p>Parade nor in the court and other accused Leda Mian<\/p>\n<p>though has been identified by only one, but was given<\/p>\n<p>benefit of doubt.\n<\/p>\n<p>         8. However, learned counsel for the appellants<\/p>\n<p>submits that, though, appellants have not been identified in<\/p>\n<p>court   and hence substantive evidence are missing and<\/p>\n<p>evidence of witnesses in the Test Identification Parade has<\/p>\n<p>got only corroborative value and        is not substantive<\/p>\n<p>evidence. Conviction on the basis of Test Identification<\/p>\n<p>Parade is not sustainable. However, learned lower court<br \/>\n<span class=\"hidden_text\">              4<\/span><\/p>\n<p>has convicted the accused on the basis of identification in<\/p>\n<p>Test Identification Parade relying on decision of Hon&#8217;ble<\/p>\n<p>Supreme Court reported in 1996 (4) Criminal Law Journal<\/p>\n<p>page 3585. However, it is a case of train dacoity, one<\/p>\n<p>culprit was arrested. The said culprit was identified during<\/p>\n<p>the Test Identification Parade conducted by the Magistrate.<\/p>\n<p>However, witnesses did not chosen to identify in trial due<\/p>\n<p>to fear. However, at this juncture during evidence trial<\/p>\n<p>court got his remark as to the demeanor of the witness that<\/p>\n<p>witness was afraid by the accused as he was trembling<\/p>\n<p>stair and it has become evident to record recognition of the<\/p>\n<p>trial and in that facts and circumstance trial court as well<\/p>\n<p>as High Court relied upon by the statement of the<\/p>\n<p>Magistrate who had conducted Test Identification Parade<\/p>\n<p>that the witness has identified the appellant before whom<\/p>\n<p>identification parade was done and hence, prosecution case<\/p>\n<p>proved beyond doubt.\n<\/p>\n<p>         9. Learned counsel for the appellants however,<\/p>\n<p>contends that two facts required to be taken into<\/p>\n<p>consideration to distinguish the decision that there is no<\/p>\n<p>demeanor recorded by the Judge of the witness examined<\/p>\n<p>about their being afraid or trembling out of fear       and<br \/>\n<span class=\"hidden_text\">               5<\/span><\/p>\n<p>witnesses 2 to 8 have declared hostile and witness no. 8<\/p>\n<p>who is informant has also not supported the prosecution<\/p>\n<p>case with regard to other and witnesses also identifying in<\/p>\n<p>Test Identification Parade have not specifically stated<\/p>\n<p>about what specific role of accused in committing dacoity.<\/p>\n<p>         10. Learned counsel for the appellants however,<\/p>\n<p>contends that witnesses claimed to have identified the<\/p>\n<p>accused persons in torch light and I.O. has not seized the<\/p>\n<p>torch light. Hence identification of appellants is doubtful.<\/p>\n<p>         11. Hence having regard to the submissions of<\/p>\n<p>the parties it is apparent that in the case, eight material<\/p>\n<p>witnesses examined did not identify the appellants          in<\/p>\n<p>court   and       hence   the   substantive   evidence   about<\/p>\n<p>identification of appellants is missing.        However, the<\/p>\n<p>identification in Test Identification Parade is secondary<\/p>\n<p>evidence. However, in decision reported the evidence in<\/p>\n<p>Test Identification Parade was taken substantive evidence<\/p>\n<p>when the court in evidence marked the demeanor that the<\/p>\n<p>witness was trembling under fear. However, under the<\/p>\n<p>facts and circumstance when majority of the witnesses not<\/p>\n<p>supported the prosecution case about identification and<\/p>\n<p>there is no demeanor recorded, hence the principle can not<br \/>\n<span class=\"hidden_text\">                                      6<\/span><\/p>\n<p>                       be applied.\n<\/p>\n<p>                                12.
