In the light of the common order dated 25.02.2008<\/p>\n<p>passed in Crl.M.C No. 543 of 2008 and connected cases,            it is<\/p>\n<p>held that the learned Magistrate was not justified in refusing to<\/p>\n<p>entertain the petition filed under Sec. 457 Cr.P.C. The petitioner<\/p>\n<p>is permitted to apply again before the learned Magistrate who<\/p>\n<p>shall release the mini lorry in question on interim custody on<\/p>\n<p>the petitioner making a cash deposit for Rs. 25,000\/- (Rupees<\/p>\n<p>twenty    five thousand       only)     and      executing  a bond for<\/p>\n<p>Rs.5,00,000\/- (Rupees five lakhs only) with two solvent<\/p>\n<p>sureties each for the like amount (without insisting on solvency<\/p>\n<p>certificate from such sureties) to the satisfaction of the<\/p>\n<p>Magistrate and on     the petitioner giving an undertaking on the<\/p>\n<p>following terms:-\n<\/p>\n<p>Crl.M.C.No.1168 of 2008<\/p>\n<p>            1.     The petitioner shall not permit the user of<br \/>\n            the lorry for any illicit purpose<\/p>\n<p>            2.    The petitioner shall not transfer wholly or in<br \/>\n            part     the lorry to any other person.<\/p>\n<p>            3.    The petitioner shall produce the lorry before<br \/>\n            the Magistrate as and when directed to do so in<br \/>\n            the same condition in which it is       released to<br \/>\n            him.\n<\/p>\n<p>            4.    The interim custody of the lorry shall be<br \/>\n            subject to final orders, if any, to be passed for<br \/>\n            confiscation.\n<\/p>\n<p>      This Crl.M.C is disposed of as above.<\/p>\n<p>                                          V.
