M.S.SHAH)<\/p>\n<p>\tThese<br \/>\nappeals under Clause 15 of the Letters Patent are directed against<br \/>\nthe common order dated 19.6.2007 of the learned Single Judge in<br \/>\nSpecial Civil Application No.12990 of 2007 and connected matters<br \/>\ndismissing the writ petitions filed by the appellants herein.\n<\/p>\n<p>2.\tThe<br \/>\nState Government had issued notification dated 12.1.1973 under<br \/>\nSection 18 of the Wild Life (Protection) Act, 1972 declaring the<br \/>\nintention of the Government to constitute certain areas for the<br \/>\npurpose of protecting, propagating or developing wild life or its<br \/>\nenvironment, particularly for declaring the said areas as wild ass<br \/>\nsanctuary. The lands in question were covered by the said<br \/>\nnotification. Thereafter, the Collector, Surendrangar published a<br \/>\nproclamation under Section 21 of the Act requiring any person<br \/>\nclaiming any right in such land, to prefer to the Collector, a<br \/>\nwritten claim specifying the nature and extent of such right, if any,<br \/>\nwith necessary details and the amount and particulars of the<br \/>\ncompensation, if any, claimed in respect thereof. Section 22 requires<br \/>\nthe Collector to make inquiries  into such claims and Section 23<br \/>\nconfers upon the Collector the powers to survey, demarcate and make a<br \/>\nmap of the land in question or to get these things done by another<br \/>\nofficer. Section 24 provides  that after holding such inquiry, the<br \/>\nCollector shall pass an order admitting or rejecting the claim in<br \/>\nwhole or in part, and if such claim is admitted in whole or in part,<br \/>\nthe Collector may either exclude such land from the limits of the<br \/>\nproposed sanctuary or proceed to acquire such land or rights, subject<br \/>\nto certain exceptions. Section 24 also permits the Collector to<br \/>\nallow, in consultation with the Chief Wild Life Warden, the<br \/>\ncontinuance of any right of any person qua such land.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe Collector issued proclamation dated 25.9.1997 under Section 21 of<br \/>\nthe Act inviting the persons claiming any right in the lands in<br \/>\nquestion to prefer written claims.\n<\/p>\n<p>\tWhile<br \/>\nthe appellants herein lodged their claims at the relevant time in<br \/>\nresponse to the above proclamation under Section 21 of the Act, when<br \/>\nthe Collector issued notices fixing the dates of hearing, it appears<br \/>\nthat the appellants either did not appear before the Collector or<br \/>\nappeared before the Collector and submitted documents which the<br \/>\nCollector did not consider to be satisfactory for the purpose of<br \/>\nadmitting their claims. Consequently, the Collector rejected the<br \/>\nclaims made by the appellants herein and rejected the request for<br \/>\nexcluding the lands in question from the limits of the proposed wild<br \/>\nass sanctuary.\n<\/p>\n<p>\tAggrieved<br \/>\nby the said orders of the Collector\/ Additional Collector,<br \/>\nSurendranagar, the appellants moved this Court by filing the writ<br \/>\npetitions. The learned Single Judge was pleased to reject the<br \/>\npetitions by common order dated 19.6.2007. Hence, these appeals.\n<\/p>\n<p>3.\tMr<br \/>\nRana, learned advocate for the appellants has submitted that the<br \/>\nappellants or their ancestors have been carrying on salt<br \/>\nmanufacturing activity on the lands in question for the last more<br \/>\nthan 50 years, since 1951 to be precise, and that the appellants have<br \/>\nsufficient evidence to show that the appellants or their ancestors<br \/>\nwere permitted to carry on salt manufacturing operations on the lands<br \/>\nin question. It is submitted that because the appellants are<br \/>\nilliterate or semi-literate, the appellants could not produce all the<br \/>\ndocuments before the Collector at the time of hearing and that if one<br \/>\nmore opportunity is given, the appellants will produce the necessary<br \/>\ndocumentary evidence in support of their claims.\n<\/p>\n<p>4.\tMr<br \/>\nShivang Shukla, learned AGP for the respondents submits that<br \/>\nsufficient opportunities were given to the appellants and the learned<br \/>\nSingle Judge has rightly dismissed the writ petitions.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned counsel for the parties, we are of the view that<br \/>\nsince the appellants claim that the appellants or their ancestors<br \/>\nhave been carrying on salt manufacturing operations on the lands in<br \/>\nquestion for the last more than 50 years and that the appellants were<br \/>\nnot in a position to produce the necessary documentary evidence<br \/>\nearlier, the interests of justice would be served if the appellants<br \/>\nare given last opportunity to produce all the documentary evidence in<br \/>\nsupport of their case within one month from today and thereupon the<br \/>\nCollector \/ Additional Collector, Surendranagar shall consider and<br \/>\ndecide the appellants&#8217; claims in accordance with law without being<br \/>\ninfluenced by the previous orders of the Collector\/ Additional<br \/>\nCollector, Surendranagar and also without being influenced by the<br \/>\nfact that the learned Single Judge had dismissed the writ petitions<br \/>\nof the appellants by the order dated 19.6.2007.\n<\/p>\n<p>\tIt<br \/>\nis directed accordingly.\n<\/p>\n<p>\tIt<br \/>\ngoes without saying that the appellants, who submit any additional<br \/>\ndocuments within one month from today, shall also be given an<br \/>\nopportunity of personal hearing before the Collector \/ Additional<br \/>\nCollector takes final decision in the matter.\n<\/p>\n<p>6.\tThe<br \/>\nappeals are accordingly disposed of in terms of the aforesaid<br \/>\ndirections.\n<\/p>\n<p>\tSince<br \/>\nthe appeals are disposed of, the civil applications for stay do not<br \/>\nsurvive and are disposed of accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.S.
