                                         “CR”\n<\/p>\n
 Is the Secretary of a Municipality empowered to<\/p>\n
 issue   permission,  transferring   a  development<\/p>\n
 permit or a building permit in part and allowing<\/p>\n
 the commencement or continuation of the work<\/p>\n
 following such transfer?\n<\/p>\n<\/p>\n
1.The  petitioner   obtained   a  development   and<\/p>\n
 building  permit.  Later,   respondents  2  and 3<\/p>\n
 purchased a portion of the land involved in that<\/p>\n
 permit and the semi-finished structures standing<\/p>\n
 thereon, with the right to continue to build that<\/p>\n
 portion. The Secretary of the first respondent<\/p>\n
 Corporation issued Ext.P8 taking the view that<\/p>\n
 the permit cannot be transferred in part. Hence,<\/p>\n
 this writ petition.\n<\/p>\n
WPC33397\/09            -: 2 :-<\/span><\/p>\n
2.Rule   21  of   the Kerala   Municipality Building<\/p>\n
 Rules,    1999,  hereinafter   referred to  as  the<\/p>\n
 “KMBR”, deals with intimation regarding transfer<\/p>\n
 of plots. Sub-rule 1 thereof provides that every<\/p>\n
 person holding development or building permit<\/p>\n
 shall, unless the work has been executed in full<\/p>\n
 and      development  or     occupancy   certificate<\/p>\n
 obtained, inform the Secretary, every transfer of<\/p>\n
 the whole or part of any property involved in the<\/p>\n
 permit together with the name and address of the<\/p>\n
 transferee and his intention to transfer, or<\/p>\n
 otherwise, the permit. This provision itself is<\/p>\n
 sufficient intrinsic tool, by way of statutory<\/p>\n
 material, to hold that there is no prohibition<\/p>\n
 for transfer of a part only, of any property<\/p>\n
 involved in a development or building permit. All<\/p>\n
 that is required is that the transfer of the<\/p>\n
 property, whether in whole or in part, has to be<\/p>\n
 intimated to the Secretary. The transferor shall<\/p>\n
 also intimate to the Secretary his intention to<\/p>\n
 transfer the permit or not. Therefore, this sub-<\/p>\n

 rule itself is sufficient indicator of the fact<\/p>\n
 that there is no embargo for the owner of the<\/p>\n
 land under development, or the building under<\/p>\n
 construction, to transfer only a part of it. Such<\/p>\n
 transfer does not require the permission of the<\/p>\n
 Secretary. The transfer is to be intimated to the<\/p>\n
 Secretary.   If   the     transferor informs  the<\/p>\n
 Secretary   of his  intention     to transfer the<\/p>\n
 permit, he essentially informs his consent for<\/p>\n
 the transfer, following which the Secretary can<\/p>\n
 proceed with any request for transfer of the<\/p>\n
 permit on such basis.\n<\/p>\n<\/p>\n
3.Sub-rule 2 of Rule 21 provides that every person<\/p>\n
 in whose favour any property is transferred along<\/p>\n
 with a development or building permit shall,<\/p>\n
 before commencing or continuing the work, obtain<\/p>\n
 permit    of the   Secretary    in  writing. This<\/p>\n
 provision specifically amplifies the fact that<\/p>\n
 the    rules envisage    that  the  Secretary can<\/p>\n
 recognize transfer of the property, however that,<\/p>\n
 the transferee shall not commence or continue the<\/p>\n

 work without obtaining permit of the Secretary.<\/p>\n
4.Sub-rule 4 of Rule 21 provides that, if convinced<\/p>\n
 that the transfer will not in any way badly<\/p>\n
 affect    the   development    or  construction,  the<\/p>\n
 Secretary    shall  issue     permission in   writing,<\/p>\n
 transferring     the   permit     and   allowing  the<\/p>\n
 commencement or continuation of the work. The<\/p>\n
 said    sub   rule  prescribes     15  days  for  the<\/p>\n
 Secretary to issue the permission from the date<\/p>\n
 of receipt of the request for it.\n<\/p>\n<\/p>\n
5.The conjoint effect of sub-rules 1 and 4 of Rule<\/p>\n
 21   is   that  the  holder     of  a  development or<\/p>\n
 building    permit  is   entitled    to transfer  the<\/p>\n
 property involved in the permit either in whole,<\/p>\n
 or in part, and the Secretary is empowered to<\/p>\n
 issue     permission transferring     the  permit  in<\/p>\n
 accordance with such transfer, if convinced that<\/p>\n
 the transfer will not, in any way, badly affect<\/p>\n
 the development or construction. Therefore, if<\/p>\n
 there is severance of the property in relation to<\/p>\n

 which the development or building permit was<\/p>\n
 originally issued, the transfer of the portion of<\/p>\n
 the    permit  can   be     effected in   favour of<\/p>\n
 transferee, to facilitate further construction.<\/p>\n
 But, this could be only made depending on, and<\/p>\n
 fully in terms with, the lay out as approved in<\/p>\n
 relation to the original permit and licence. By<\/p>\n
 virtue of sub rule 2 of Rule 21 of KMBR, such<\/p>\n
 application can be considered by the Secretary<\/p>\n
 and permit that the Secretary would issue in<\/p>\n
 terms of Rule 21(2) is a permit to continue the<\/p>\n
 work in terms of the approved lay out and the<\/p>\n
 building     permit\/development     permit   already<\/p>\n
 granted.\n<\/p>\n<\/p>\n
6.The issue in hand can be looked at from a<\/p>\n
 different angle also. Even if it were that the<\/p>\n
 original grantee of the development or building<\/p>\n
 permit completes the construction, there is no<\/p>\n
 law which prohibits the transfer of the whole or<\/p>\n
 a part of the completed building. Therefore, it<\/p>\n
 would be unreasonable to say that such transfer<\/p>\n

 cannot be made before the completion. The very<\/p>\n
 provision   in  Rule    21(1),  casting  statutory<\/p>\n
 responsibility on the transferor to inform, by<\/p>\n
 itself provides the statutory clue that transfer<\/p>\n
 before completion is not forbidden. Logically,<\/p>\n
 therefore, even in cases where the work is yet to<\/p>\n
 be executed in full, the grantee of the licence<\/p>\n
 is entitled to transfer any part of the property<\/p>\n
 in relation to which the permit is granted and<\/p>\n
 also to express his intention; thereby meaning,<\/p>\n
 consent, to transfer the permit. Such transfer of<\/p>\n
 the permit shall be in terms of the order of the<\/p>\n
 Secretary   in consonance    with Rule  21(2)  in<\/p>\n
 relation to the portion of the property covered<\/p>\n
 by the transfer without, in any manner, impairing<\/p>\n
 the lay out fixed originally, in relation to the<\/p>\n
 development   or  building    permit,  as   issued<\/p>\n
 initially to the transferor.\n<\/p>\n
 In   the  light of  what    is stated  above,  the<\/p>\n
 impugned Ext.P8 order taking the view that there<\/p>\n
 cannot be a partial transfer of permit is quashed<\/p>\n

 and the first respondent is directed to take up<\/p>\n
 the   request of  the   petitioner and  that  the<\/p>\n
 respondents 2 and 3 may make, for transfer of the<\/p>\n
 portion of Ext.P7 development\/building permit in<\/p>\n
 terms of what is stated above. Let this be done<\/p>\n
 within a period of two weeks from the date of<\/p>\n
 receipt of a copy of this judgment. Writ petition<\/p>\n
 ordered accordingly.\n<\/p>\n<\/p>\n
