No.44075 of 2010\nKASHI RAI, son of Raghunath Rai, resident of village - Chhapra\nBahar, P.S. - Sugauli, District - East Champaran at Motihari.\n                                                 ----- Petitioner.\n                               Versus\nTHE STATE OF BIHAR                             --- Opposite Party\n                              -------\n<\/pre>\n<p> 02. 15.12.2010         Heard learned counsel for the petitioner<\/p>\n<p>                 and learned Additional Public Prosecutor for<\/p>\n<p>                 the State.\n<\/p>\n<p>                          Petitioner is named accused in this case<\/p>\n<p>                 being    husband          of    the    deceased,    about      whose<\/p>\n<p>                 death and disposal of the body, six days after<\/p>\n<p>                 village choukidar on getting vague information<\/p>\n<p>                 got the case instituted and as it appears from<\/p>\n<p>                 the order of learned Sessions Judge, there is<\/p>\n<p>                 nothing       to     show        any    involvement       of     the<\/p>\n<p>                 petitioner         with    whom       his    father-in-law       i.e.<\/p>\n<p>                 father of the deceased had already entered into<\/p>\n<p>                 compromise and much before made statement under<\/p>\n<p>                 section       161    of    the       Cr.P.C.   exonerating       the<\/p>\n<p>                 petitioner.\n<\/p>\n<p>                           Considering the facts and circumstances<\/p>\n<p>                 of      the     case,           in     the     event      of     his<\/p>\n<p>                 arrest\/surrender before the court below within<\/p>\n<p>                 four    weeks       of    receipt      of    the   copy   of     this<\/p>\n<p>                 order,    and       one    of    the    bailors    must     be   the<\/p>\n<p>                 father    of       the    deceased,         petitioner,    namely,<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>          Kashi Rai, is directed to be released on bail<\/p>\n<p>          on furnishing bail bond of Rs. 10,000\/- (ten<\/p>\n<p>          thousand only) with two sureties of the like<\/p>\n<p>          amount     each   to    the    satisfaction    of   Chief<\/p>\n<p>          Judicial    Magistrate,       Motihari,   in   connection<\/p>\n<p>          with Sugauli P.S. case No. 57 of 2007, subject<\/p>\n<p>          to condition laid down under Section 438(2) of<\/p>\n<p>          the   Criminal    Procedure     Code   with    additional<\/p>\n<p>          condition to remain physically present before<\/p>\n<p>          the court below on each and every date at least<\/p>\n<p>          for two years or till disposal of the case<\/p>\n<p>          whichever is earlier, in case of failure on two<\/p>\n<p>          consecutive dates, the liberty shall be deemed<\/p>\n<p>          to be cancelled.\n<\/p>\n<\/p>\n<pre>Rajeev\/                                   (Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kashi Rai vs The State Of Bihar on 15 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
