No.1934 of 2009\n                         SAJJAN KUMAR BAJORIA\n                                     Versus\n                       AMRISH CHANDRA SHARMA\n                                   -----------\n<\/pre>\n<p>3   27.10.2010            Learned counsel for the petitioner submits<\/p>\n<p>                 that in view of the law laid down by the Apex Court<\/p>\n<p>                 in the cases of <a href=\"\/doc\/213017\/\">Shiv Shakti Coop. Housing Society,<\/p>\n<p>                 Nagpur v. Swaraj Developers and others<\/a> ((2003) 6<\/p>\n<p>                 Supreme Court Cases, 659) and <a href=\"\/doc\/1016548\/\">Surya Dev Rai v.<\/p>\n<p>                 Ram Chander Rai and others<\/a> ((2003) 6 SCC, 675)<\/p>\n<p>                 as well as by a Division Bench of this Court in<\/p>\n<p>                 <a href=\"\/doc\/55539251\/\">Durga Devi v. Vijay Kumar Poddar and others<\/p>\n<p>                 and<\/a> its analogous cases (2010(2) PLJR 954) while<\/p>\n<p>                 deciding the maintainability of the Civil Revision in<\/p>\n<p>                 group of cases, this civil revision would not be<\/p>\n<p>                 maintainable.\n<\/p>\n<p>                          Learned     counsel    for      the   petitioner,<\/p>\n<p>                 therefore, seeks permission to convert this civil<\/p>\n<p>                 revision into a writ application under Article 227 of<\/p>\n<p>                 the Constitution of India in view of the decision of the<\/p>\n<p>                 Division Bench rendered in Durga Devi (supra)<\/p>\n<p>                 referred to above, while deciding the issue of<\/p>\n<p>                 maintainability of the Civil Revision.<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>                 Permission is accorded<\/p>\n<p>                  Let the petitioner convert this civil revision<\/p>\n<p>        into a writ application under Article 227 of the<\/p>\n<p>        Constitution of India within four weeks, failing which<\/p>\n<p>        this civil revision shall stand rejected as not<\/p>\n<p>        maintainable without further reference to a Bench.<\/p>\n<p>                        (Dr. Ravi Ranjan, J.)<br \/>\nSpd\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sajjan Kumar Bajoria vs Amrish Chandra Sharma on 27 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA C.R.
