           Petitioner, the father of deceased<\/p>\n
Aneesh Kumar, who was found dead in the early<\/p>\n
morning of 10\/3\/2002 at the work place in a<\/p>\n
suspicious manner, filed this petition under<\/p>\n
Article 226 of Constitution of India for a writ<\/p>\n
of mandamus  directing               investigation of crime<\/p>\n
No.47\/2010  of        Valiyamala                Police      Station,<\/p>\n
registered  under         Section            174         of Code of<\/p>\n
Criminal Procedure, by a               Special Investigation<\/p>\n
Team, excluding         respondents 3 and 4 and to<\/p>\n
complete the investigation within a time frame.<\/p>\n
       2. Deceased Aneesh Kumar was working<\/p>\n
as   Work   Supervisor                       in         Sree  Dhanya<\/p>\n
Constructions. At the time of his death,                         he<\/p>\n
was engaged in the work site                       at Chullimanoor<\/p>\n

near    Nedumangadu.    Petitioner  would  contend<\/p>\n
that police is     now making   watchman  Murugan,<\/p>\n
the sole accused suppressing the true facts. It<\/p>\n
is contended that though prosecution alleges<\/p>\n
that      Aneesh Kumar had consumed liquor on the<\/p>\n
previous night,      he is not in the habit of<\/p>\n
drinking      and    postmortem certificate shows<\/p>\n
that     he  had  not   consumed  liquor.  Accused<\/p>\n
Murugan      is the helper of   abkari contractors<\/p>\n
and he is only a paid accused. It is also<\/p>\n
contended that     dress and   watch found on the<\/p>\n
dead body does not belong to the deceased and<\/p>\n
though it was pointed     out by the petitioner to<\/p>\n
the    investigating   officer,  that  aspect  was<\/p>\n
disregarded and petitioner was threatened. It<\/p>\n
is also alleged that some of the co-workers<\/p>\n
were transferred after the incident. These are<\/p>\n
suspicious circumstances, which warrant proper<\/p>\n
investigation.\n<\/p>\n

           2. Circle Inspector, Nedumangadu   filed<\/p>\n
a   statement     showing   the  progress  of   the<\/p>\n
investigation.      Statement  reveals  that  crime<\/p>\n
under Section 174 of Code of Criminal Procedure<\/p>\n
was     registered    based   on   the  information<\/p>\n
furnished by Murugan, the watch man of the work<\/p>\n
site    and    the  statement  discloses  that  the<\/p>\n
deceased along with      other workers had consumed<\/p>\n
liquor and on the morning, he was found dead<\/p>\n
and Assistant Sub Inspector of Police arranged<\/p>\n
to take photographs of the body of the deceased<\/p>\n
and    conducted    inquest   which  revealed  five<\/p>\n
visible abrasions      and the body   was sent  for<\/p>\n
autopsy.       Dr.Sharija,   Senior  Lecturer   and<\/p>\n
Assistant       Police   Surgeon,   Department   of<\/p>\n
Forensic       Medicine   conducted   autopsy.   He<\/p>\n
certified the cause of death as due        to   the<\/p>\n
blunt       injury   sustained   to  abdomen.   Sub<\/p>\n
Inspector      of  Police   therefore  altered  the<\/p>\n

offence to Section 302 of Indian Penal Code<\/p>\n
and sent a report to the Magistrate. Circle<\/p>\n
Inspector of Police, Nedumangad took over the<\/p>\n
investigation      on    15\/3\/2010.     On    the<\/p>\n
investigation    conducted  and  questioning  the<\/p>\n
accused Murugan finding that he is involved, he<\/p>\n
was arrested on 16\/3\/2010. Remaining        broken<\/p>\n
torch light which was used by the accused to<\/p>\n
assault     the  deceased   was  recovered      on<\/p>\n
17\/3\/2010 at 10 p.m from the STD booth near the<\/p>\n
scene of crime, based on           the confession<\/p>\n
statement     of the  said  Murugan.  Murugan  was<\/p>\n
shown as the accused and report was submitted<\/p>\n
before the Magistrate.      Investigation reveals<\/p>\n
that    Murugan  alone  was  responsible  for  the<\/p>\n
murder      of  Aneesh  Kumar   and   a  thorough<\/p>\n
investigation is being conducted.<\/p>\n
           3. Learned  Government   Pleader  made<\/p>\n
available     the  case  diary.  It  is   perused.<\/p>\n

Learned     counsel appearing for the  petitioner<\/p>\n
and learned Government Pleader   were heard.<\/p>\n
           4. Though  learned  counsel vehemently<\/p>\n
argued that there was      allegation with regard<\/p>\n
to the construction of      road and based on a<\/p>\n
complaint, enquiry was conducted and deceased<\/p>\n
Aneesh      Kumar   had   knowledge   about   the<\/p>\n
malpractices therein and it is for that reason<\/p>\n
the Management was interested in seeing Aneesh<\/p>\n
Kumar dead and this aspect was not properly<\/p>\n
investigated, going through the case diary, I<\/p>\n
do not find that any material was unearthed to<\/p>\n
support     any of  allegations. No  material  is<\/p>\n
produced     to  show  that  an  enquiry  on  the<\/p>\n
construction    of road was even made. Petitioner<\/p>\n
did not make available any material in support<\/p>\n
of any of the allegations.\n<\/p>\n
           5.  Learned  counsel  then argued that<\/p>\n
postmortem certificate      does not reveal that<\/p>\n

deceased      Aneesh  Kumar  had  consumed  liquor.<\/p>\n
Postmortem certificate will not reveal whether<\/p>\n
deceased had consumed liquor or not.        Stomach<\/p>\n
contents were collected and sent for chemical<\/p>\n
analysis. Unless       the report is obtained, it<\/p>\n
cannot be found out whether the deceased had<\/p>\n
consumed       liquor   on   the  previous   night.<\/p>\n
Therefore,      for  the   reason  that  postmortem<\/p>\n
certificate does not reveal that deceased       had<\/p>\n
consumed liquor, it cannot      be  said that there<\/p>\n
was no proper investigation.\n<\/p>\n
           6. Though    learned   counsel    argued<\/p>\n
that        Circle  Inspector   Pradeep  Kumar  had<\/p>\n
threatened the petitioner, it is seen from the<\/p>\n
case diary that Pradeep Kumar had      investigated<\/p>\n
the case      only   till May 2010 and the case is<\/p>\n
thereafter       being   investigated   by   Circle<\/p>\n
Inspector,      P.Velayudhan Nair.  On perusing the<\/p>\n
case diary, I do not find that any particular<\/p>\n

aspects were not investigated      and omitted to<\/p>\n
be investigated. Therefore, I do not    find that<\/p>\n
in the interest      of justice  the investigating<\/p>\n
agency is to be changed as sought for.<\/p>\n
           Considering  the   grievance  of   the<\/p>\n
petitioner, in the interest of justice, it is<\/p>\n
directed that investigation is to be conducted<\/p>\n
by the Circle Inspector of Police, under the<\/p>\n
supervision of an officer not below the rank of<\/p>\n
Deputy Superintendent of Police. Superintendent<\/p>\n
of Police,      Thiruvananthapuram is directed to<\/p>\n
see that investigation of crime No.47\/2010 of<\/p>\n
Valiyamala police station is supervised by a<\/p>\n
competent Senior police officer not below the<\/p>\n
rank of Deputy Superintendent of Police. The<\/p>\n
investigation must be fair and effective.<\/p>\n
