He has also submitted that he is not doing any business and<br \/>\n\tnot receiving any adequate remuneration.\n<\/p>\n<p>Special<br \/>\n\tCivil Application No.17096 of 2004 has been filed by Bhavnagar<br \/>\n\tDistrict Panchayat wherein award passed by learned Labour Court,<br \/>\n\tBhavnagar in Reference (LCB) No.425 of 1989 to 430 of 1989 and 476<br \/>\n\tof 1989 to 479 of 1989 were challenged. Present workman&#8217;s references<br \/>\n\twas reference (LCB) No.479 of 1989, which was one of eight<br \/>\n\treferences, where common award was passed by learned Labour Court on<br \/>\n\t06.07.2004 and learned Labour Court has granted reinstatement in<br \/>\n\tservice and awarded lumpsum amount of Rs.3000\/- in view of<br \/>\n\tbackwages.\n<\/p>\n<p>On<br \/>\n\t30.12.2004, this Court, while issuing Rule, granted ad-interim<br \/>\n\trelief in terms of Para-6(C). It is specifically prayed in Para-6(C)<br \/>\n\tto stay implementation, execution and operation of award passed by<br \/>\n\tlearned Labour Court, Bhavnagar on 06.07.2004.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Yogen pandya appearing on behalf of present applicant<br \/>\n\tsubmitted that present applicant did not filed any affidavit on oath<br \/>\n\tbefore this Court for not doing any gainful employment. Therefore,<br \/>\n\the seeks last drawn wages as per provisions of 17-B of Industrial<br \/>\n\tDisputes Act, 1947. In this application, specific averments has been<br \/>\n\tmade that he is not doing any business and not receiving any<br \/>\n\tadequate remuneration from the date of termination. No counter<br \/>\n\taffidavit is filed by original petitioner.\n<\/p>\n<p>In<br \/>\n\tlight of this background, this Court has passed the order on<br \/>\n\t30.12.2004 and granted stay against reinstatement without any<br \/>\n\tcondition. It is a duty of employer to comply the provisions of<br \/>\n\tSection 17-B of the Industrial Disputes Act, 1947, when stay has<br \/>\n\tbeen obtained against reinstatement. However, because of common<br \/>\n\taward passed by learned Labour Court, Bhavnagar in common References<br \/>\n\twas addressed to Union and therefore, workman was not able to get<br \/>\n\tinformation about the order passed by learned Labour Court and this<br \/>\n\tCourt in Special Civil Application No.17096 of 2004.\n<\/p>\n<p>According<br \/>\n\tto my opinion, workman is entitled for last drawn wages. It is<br \/>\n\tdirected to original petitioner to pay last drawn wages from the<br \/>\n\tdate of award i.e. 06.07.2004 to 30.04.2010 within a period 1(One)<br \/>\n\tmonth from the date of receiving a copy of this order. It is further<br \/>\n\tdirected to petitioner to pay last drawn wages regularly till<br \/>\n\tSpecial Civil Application is finally decided by this Court.\n<\/p>\n<p>However,<br \/>\n\tit is made clear by this Court that in case if, original petitioner<br \/>\n\tis having any material or cogent evidence to establish the fact<br \/>\n\tbefore this Court that workman is gainfully employed in any<br \/>\n\testablishment and receiving adequate remuneration then, it is open<br \/>\n\tfor the petitioner to file such application before this Court for<br \/>\n\tmodification of present order.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid observations and directions, present application<br \/>\n\tis disposed of.\n<\/p>\n<p>Ad-interim<br \/>\n\trelief granted on 30.12.2004 is confirmed till the Special Civil<br \/>\n\tApplication is finally decided by this Court.\n<\/p>\n<p>(H.K.RATHOD,<br \/>\nJ.)<\/p>\n<p>..mitesh..\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ibrahimbhai vs Bhavnagar on 4 May, 2010 Author: H.K.Rathod,&amp;Nbsp;
