SANKARAN, J.\n                      ---------------------------\n                      B.A. No. 4861 of 2009\n                  ------------------------------------\n             Dated this the 30th day of October, 2009\n\n                             O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos.1 and 2 in Crime No.332\/2009 of Kottayam West Police<\/p>\n<p>Station.\n<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 406 and 420 of the Indian Penal Code.<\/p>\n<p>     3.    When the Bail Application came up for hearing on<\/p>\n<p>20.10.2009, the following order was passed:<\/p>\n<blockquote><p>             &#8220;After having heard the learned counsel for<\/p>\n<p>       the petitioners and the learned Public Prosecutor,<\/p>\n<p>       I am of the view that before disposing of the Bail<\/p>\n<p>       Application, an opportunity should be given to<\/p>\n<p>       the petitioners to appear before the investigating<\/p>\n<p>       officer. Accordingly, there will be a direction to<\/p>\n<p>       the petitioners to appear before the investigating<\/p>\n<p>       officer at 9 A.M. on 26th and 27th October, 2009.<\/p>\n<\/blockquote>\n<blockquote><p>             Post on 30.10.2009.\n<\/p><\/blockquote>\n<blockquote><p>             It is submitted by the learned Public<\/p>\n<p>       Prosecutor that the petitioners will not be<\/p>\n<p>       arrested until further orders in connection with<\/p>\n<p><span class=\"hidden_text\">B.A. No. 4861 of 2009               2<\/span><\/p>\n<p>        Crime No.332\/2009 of Kottayam West Police<\/p>\n<p>        Station.\n<\/p><\/blockquote>\n<blockquote><p>         Hand over copy of this order to both sides.&#8221;<\/p><\/blockquote>\n<p>      4. The learned counsel for the petitioners and the learned<\/p>\n<p>Public Prosecutor submitted that the petitioners have complied<\/p>\n<p>with the directions in the order dated 20.10.2009.<\/p>\n<p>      4.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station shall release<\/p>\n<p>them on bail on their executing bond for Rs.15,000\/- each with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioners      shall   report    before    the<br \/>\n            investigating officer between 9 A.M and 11 A.M.<br \/>\n            on all alternate Mondays, till the final report is<br \/>\n            filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The    petitioners    shall   appear   before    the<br \/>\n            investigating officer for interrogation as and<br \/>\n            when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n            prosecution     witnesses   or  tamper    with   the<br \/>\n            evidence.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 4861 of 2009             3<\/span><\/p>\n<p>         D) The petitioners shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to be<br \/>\n            cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                   K.T.
