No.18196 of 2010\n         NILESH KUMAR @ SONU SINGH @ SONU AGRAWAL S\/O SURENDRA\n                              SINGH\n                                          Versus\n                                   STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3.   2.7.2010               Heard learned Counsel for the petitioner, the State and<\/p>\n<p>                the informant.\n<\/p>\n<p>                            The petitioner seeks bail in a case instituted for the<\/p>\n<p>                offence under Sections 467, 468, 406 and 420\/34 of the Indian<\/p>\n<p>                Penal Code.\n<\/p>\n<p>                            It has been submitted that the petitioner is in custody<\/p>\n<p>                since 25.2.2010 and the charge sheet has already been submitted<\/p>\n<p>                in the case and the petitioner has no criminal antecedents.<\/p>\n<p>                            In view of such, let the petitioner above named be<\/p>\n<p>                released on bail on furnishing bail bond of Rs.5,000\/- (Five<\/p>\n<p>                thousand) with two sureties of the like amount each to the<\/p>\n<p>                satisfaction of A.C.J.M., Patna City, Patna in Agamkuan P.S.case<\/p>\n<p>                No.20 of 2010, subject to the conditions (i) That one of the bailors<\/p>\n<p>                will be a close relative of the petitioner who will give an affidavit<\/p>\n<p>                giving genealogy as to how he is related with the petitioner. The<\/p>\n<p>                bailor will undertake to furnish information to the court about any<\/p>\n<p>                change in the address of the petitioner. The Magistrate concerned<\/p>\n<p>                shall insist upon proper verification of the petitioner and the bailors<\/p>\n<p>                so that is no dispute with regard to the petitioner&#8217;s identity at a later<\/p>\n<p>                stage, (ii) that the affidavit shall clearly state that the petitioner is<\/p>\n<p>                not an accused in any other case and if he is he shall not be<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            released on bail, (iii) that the bailor shall also state on affidavit that<\/p>\n<p>            he will inform the court concerned if the petitioner is implicated in<\/p>\n<p>            any other case of similar nature after his release in the present<\/p>\n<p>            case and thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on the ground of misuse and (iv)<\/p>\n<p>            that the petitioner will give an undertaking that he will receive the<\/p>\n<p>            police papers on the given date and be present on date fixed for<\/p>\n<p>            charge and if he fails to do so on two given dates and delays the<\/p>\n<p>            trial in any manner, his bail will be liable to be cancelled for reasons<\/p>\n<p>            of misuse.\n<\/p>\n<p>                         The informant appears and both parties undertake that<\/p>\n<p>            they will ensure that the trial is concluded at the earliest.<\/p>\n<p>                                    ( Anjana Prakash, J. )<\/p>\n<p>Narendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nilesh Kumar @ Sonu Singh @ Sonu &#8230; vs State Of Bihar on 2 July, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
