4. Brief facts of the case are:\n<\/p>\n
That on 25-5-07, When the claimant was crossing
\nthe road in front of her house on 431 cross. at<\/p>\n
V.V.Layout, a motor cycle bearing registration fNo.KA-<\/p>\n
04430-8614 came at high speed in a rash <\/p>\n
manner and dashed against her.\n<\/p>\n
claimant fell down and sustained _inj#.V1ries’, ‘ <\/p>\n
a minor, claim petitioncwas filedl”~thro1V.1vgii.. her <\/p>\n
who is her natural    WMACT,

\nThe Tribunalpby amgugiiegillj;idgni\u00a2l:\u00a7iand award has
\nawarded   \/– with interest at
\n80\/0 lvpia: “l quantum of compensation
\nawardedi\u00ab._il)y’v.  the claimant is in appeal<\/p>\n
 enhancement of compensation.\n<\/p>\n
‘  ‘_’t.h’er_e is no dispute regarding occurrence of<\/p>\n
l’accident;’j_negligence and liability of the insurer of the<\/p>\n
oflendigng V\u20achiCl\u20ac, the only point that remains for my<\/p>\n

just and proper or does it call for

6. After hearing the iearned Counsel for the parties
\nand perusing the award of the Tribunal. I am___of the<\/p>\n
View that the compensation awarded by the  is<\/p>\n
not just and proper. it is on the lower <\/p>\n
it is deserved to be enhanced.\n<\/p>\n
7. The ciaimant has sustained 1t_he’;foIio\\’Virig <\/p>\n
Crush injury’io”‘~.her right. _gri’eat;.__”toe. and it<\/p>\n
was amputed.\n<\/p>\n
Injuries sustaiiied  ‘evident from the<\/p>\n
wouridddwt’   discharge summary _
\nEx.Pz.’6.– \u00abcase X-ray –~ EX.P.1I and<\/p>\n
supported by\u00bbor’-a1i’cViCi.enoe of the father of the claimant<\/p>\n
‘  . and doctor exar\ufb01iried as P.Ws.1 and 2 respectively.<\/p>\n
3  1 an Orthopaedic Surgeon has stated in his<\/p>\n
 claimant has suffered disability of 24% to<\/p>\n
 AA rightiipper limb and 9% to the whole body.<\/p>\n
  Considering the nature of injuries. Rs.40,000\/~<\/p>\n
awarded by the Tribunal towards pain and suffering is<\/p>\n
$3,<\/p>\n
on the lower side and it is deserved to be enhanced by
\nanother Rs.10,000\/- and I award Rs.50,000\/– under<\/p>\n
this head.\n<\/p>\n
9. Claimant has produced  _,:fo,r<\/p>\n
Rs.25,429\/- and the Tribunal has award\ufb01\u00e9li <\/p>\n
towards hospitalisation charges and  4exp,en.s_es;,<\/p>\n
which is not Correct. The’refore,”‘avl’sum  <\/p>\n
is awarded towards  per bills
\nproduced by the        <\/p>\n
10. Claimant was  22-5\u00ab~07 to
\n26~\u00bb5\u00ab~O7     ir’i”:HOSMAT hospital},
\nthe same, Rs.5,000\/- awarded
\nby the incidental expenses, such as<\/p>\n
coi1Ve;yance,l l\u00b0foQC1_r.vand nourishment and attendant<\/p>\n
‘ chargesi ivispljust and proper and there is no scope for<\/p>\n
l’ enhanceliiieiit under this head.<\/p>\n
 pp Claiinant must have been under rest and<\/p>\n
it it treatrrlient for a period of one month, during which<\/p>\n
hlgperiod, she must have been looked after by her parents<\/p>\n
leaving their regular work. Therefore, Rs.5000\/~ is
\nawarded towards loss of income of the parents during<\/p>\n
laid up period.\n<\/p>\n
12. Claimant who is a young girl aged a’:b’ou.t <\/p>\n
at the time of accident, has :i’ost—-her’_:’greatj.toe.u’<\/p>\n
Considering the disability stated doctor <\/p>\n
to limb and 9% to whole  Rs.V.25,.000_”\/,– xawardjed  V<\/p>\n
the Tribunal towar.d’s.__loss*t’ol”‘a.rnei1ities lis”‘o11’l’the lower
\nside and it is deserved be_.~..enhan_ced by another<\/p>\n

13.  about 5 years. Multiplier
\napplicable wtoulageis ‘ 15’. Notional income can
\nbe takelngas, – per year. Doctor has stated.<\/p>\n
 su.ffe’1*ed____d\u00bbisabi1ity of 24% to right upper limb<\/p>\n
‘  iteorwhole body, which may be taken as 10%. So<\/p>\n
 of income works out to Rs.22,600\/–<\/p>\n
(Rs~;l5;.,.000\/– X 10\/100 X 15) and it is awarded as<\/p>\n
 ,  Rs.20,250\/– awarded by the Tribunal.<\/p>\n

14. Claimant by virtue of loosing her right great toe is
\ndeprived from participating in sports and other<\/p>\n
curricular activities like that of a normal girl andfttgwill<\/p>\n
also cause inconvenience to her education  and<\/p>\n
marriage prospects. Considering the  a.js11_ri13o\u00abf__ <\/p>\n
Rs.50.000\/– is awarded towards :ncontreni4e’nce-catidsed<\/p>\n
to education career and loss\u00e9of marriage pVro.spects.\u00b0’: V<\/p>\n
15. Thus the claimant is” for ‘vt-heJ\u00a7follo\\m’.ng<\/p>\n
