DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP waives service of rule.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicants submit that investigation<br \/>\n\tis over and charge sheet is filed.  It is further submitted<br \/>\n\tthat the allegations levelled against the applicants are of stealing<br \/>\n\tgas cylinders and the case is Magistrate triable case.  It is<br \/>\n\tfurther submitted that considering the nature of<br \/>\n\tallegations and role attributed to the applicants, by imposing<br \/>\n\tsuitable conditions,  the applicants may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact<br \/>\n\tthat charge sheet is filed,<br \/>\n\twithout discussing the evidence in detail, at this stage, I am<br \/>\n\tinclined to enlarge the applicants on bail  in connection with<br \/>\n\tC.R.No.I-14\/2010 of Limdi Police Station, Dis. Surendranagar   for<br \/>\n\tthe offences punishable under sections 457, 380, 114 of the Indian<br \/>\n\tPenal Code, on furnishing   bond of Rs.10,000\/- (Rupees ten thousand<br \/>\n\tonly) each with one surety of the like amount to the satisfaction of<br \/>\n\tthe lower Court and on conditions that the applicants shall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately;\n<\/p>\n<p>[h]\tshall not<br \/>\nenter district and city limits of Rajkot and Surendranagar, except<br \/>\nfor marking presence and attending trial.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
