Justice K.T.SANKARAN\n\n Dated :16\/07\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n                     ------------------------------\n                         B.A.No.3840 of 2009\n                    -------------------------------\n                Dated this the 16th day of July, 2009\n\n\n                                ORDER\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioners are the accused Nos.1<\/p>\n<p>to 3, 5 to 7 and 9 to 11 in Crime No.250 of Anchalumoodu Police<\/p>\n<p>Station.\n<\/p>\n<p>      2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 341, 323, 324 and 308 read with Section 149<\/p>\n<p>of the Indian Penal Code.\n<\/p>\n<p>      3.    The gist of the prosecution case is as follows: The defacto<\/p>\n<p>complainant went to a toddy shop enquiring about his friends. At that<\/p>\n<p>time, money was demanded by the accused persons from the defacto<\/p>\n<p>complainant. He refused to pay. At that time, he was attacked by the<\/p>\n<p>accused persons with bottles and by hand. He sustained injuries and<\/p>\n<p>he was hospitalised. The wound certificate shows that he has stated to<\/p>\n<p>the doctor that 40 persons attacked him. The injuries are not serious<\/p>\n<p>in nature.\n<\/p>\n<p>      4.    Taking into account the facts and circumstances of the<\/p>\n<p>case,   the nature of the offence, the injury sustained and other<\/p>\n<p>circumstances, I am of the view that anticipatory bail can be granted<\/p>\n<p><span class=\"hidden_text\">BA No.3840\/2009                       2<\/span><\/p>\n<p>to the petitioners.\n<\/p>\n<p>      There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station shall release them<\/p>\n<p>on bail for a period of one month on their executing bond for<\/p>\n<p>Rs.25,000\/- each with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<p>a)    The petitioners shall report before the investigating officer<br \/>\n      between 9 A.M.        and 11 A.M. on all Mondays, till the final<br \/>\n      report is filed or until further orders;\n<\/p>\n<p>b)    The petitioners shall appear before the investigating officer for<br \/>\n      interrogation as and when required;\n<\/p>\n<p>c)    The petitioners shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;\n<\/p>\n<p>d)    The petitioners shall not commit any offence or indulge in any<br \/>\n      prejudicial activity while on bail;\n<\/p>\n<p>e)    On the expiry of the period mentioned above or even before that<br \/>\n      period, the petitioners shall surrender before the Magistrate<br \/>\n      concerned and seek regular bail;\n<\/p>\n<p>f)    In case of breach of any of the conditions mentioned above, the<br \/>\n      bail shall be liable to be cancelled.\n<\/p>\n<p>\n      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                    K.T.SANKARAN,<br \/>\n                                                        JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Renjith vs State Of Kerala on 16 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3840 of 2009() 1.
