No.196\/90.  The admitted position is that<br \/>\nthe first  respondent had entered into an agreement on March<br \/>\n11,1983 to  puchase  3\tacres  28  gunthas  of\tland  for  a<br \/>\nconsideration of  Rs.12,000\/- and  he had  paid Rs.2000\/- as<br \/>\nearnest money.\tThe petitioner-second defendant puchased the<br \/>\nself-same property  on july  8, 1983  for a consideration of<br \/>\nRs.6000\/- and  had  the\t sale  deed  registered.  The  first<br \/>\nrespondent filed  the suit  for\t specific  performance.\t The<br \/>\ntrial Court  finding that  the petitoner  had purchased\t the<br \/>\nproperty and  it would\tcause irreparable  damage to  him if<br \/>\ndecree for  specific performance being would be granted, had<br \/>\nderected refund\t of the\t earnest money\twith  interest.\t The<br \/>\nfirst respondent carried the matter in appeal. The appellate<br \/>\nCourt set aside the decree of the trial Court on the finding<br \/>\nthat the  petitioner had not pleaded that he was a bona fide<br \/>\npurchaser for value without notice of the prior agreement of<br \/>\nsale. It  also had  held that  the refusal to grant rlief of<br \/>\nspecific performance  on that  ground was  not valid in law.<br \/>\nAccordingly, it\t reversed the  decree of the trial Court and<br \/>\ngranted specific performance. In the second appeal, the High<br \/>\nCourt while upholding the pleading of the respondent that he<br \/>\nwas ready  and willing\tto perform his part of the agreement<br \/>\nand that  he had  led the  evidence in that behalf, remitted<br \/>\nthe matter  to the  district Court  to frame an issue on the<br \/>\nbasis of  a previous  judgment and  the issue in this behalf<br \/>\nwas required  to  be  settled.\tWe  need  not  go  into\t the<br \/>\ncorrectness of\tthe remand  order since the first respondent<br \/>\nhas not\t filed any  SLP against\t that order.  Suffice it  to<br \/>\nstate that the petitioner has no cause for grievance in this<br \/>\nmatter for remanding the matter. In view of the finding that<br \/>\nhe is  a subsequent  purchaser, as  found by the trial Court<br \/>\nitself, and  that the  High Court has remitted the matter to<br \/>\nframe the  issue whether  the first respondent was ready and<br \/>\nwilling to  perform his\t part of the contract and decide the<br \/>\nmatter on the basis of the evidence already on record, we do<br \/>\nnot think  that there  is any  error of law committed by the<br \/>\nHigh Court in remitting the matter.\n<\/p>\n<p>     The SLP is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Revappa Gurusiddappa vs Thakubsi Madhavarao Patil &amp; Ors on 4 September, 1996 Author: K Ramaswamy Bench: Ramaswamy, K.
