VIKAS SHUKLA\n                  BOTH SONS OF AJAY SHUKLA\n                                    Versus\n                              STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   02.07.2010           Heard learned counsel for the petitioner and<\/p>\n<p>                  the State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted<\/p>\n<p>                  for the offence under Sections 392 and 411 of the<\/p>\n<p>                  Indian Penal Code.\n<\/p>\n<p>                             It has been submitted that it is highly<\/p>\n<p>                  unlikely that father and sons together would commit<\/p>\n<p>                  robbery.\n<\/p>\n<p>                             Considering the same, let the petitioners,<\/p>\n<p>                  above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs. 5,000\/- (five thousand) each with two<\/p>\n<p>                  sureties of the like amount each to the satisfaction of<\/p>\n<p>                  the Judicial Railway Magistrate, Gaya, in connection<\/p>\n<p>                  with Sasaram Rail P.S. case no. 27\/2010, subject to<\/p>\n<p>                  the conditions, (i) That one of the bailors will be a<\/p>\n<p>                  close relative of the petitioners, who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with<\/p>\n<p>                  the    petitioners      and      the     other     bailor<br \/>\n<span class=\"hidden_text\">                          -2-<\/span><\/p>\n<p>         shall be local since petitioner belongs to Patna. The<\/p>\n<p>         bailors will undertake to furnish information to the<\/p>\n<p>         court about any change in the address of the<\/p>\n<p>         petitioners, (ii) That the affidavit shall clearly state<\/p>\n<p>         that the petitioners are not an accused in any other<\/p>\n<p>         case and, if they are, they shall not be released on<\/p>\n<p>         bail, (iii) That the bailor shall also state on affidavit<\/p>\n<p>         that they will inform the court concerned if the<\/p>\n<p>         petitioners are implicated in any other case of similar<\/p>\n<p>         nature after his release in the present case and<\/p>\n<p>         thereafter the court below will be at liberty to initiate<\/p>\n<p>         the proceeding for cancellation of bail on the ground<\/p>\n<p>         of misuses, (iv) That the petitioners will give an<\/p>\n<p>         undertaking that they will receive the police papers<\/p>\n<p>         on the given date and be present on date fixed for<\/p>\n<p>         charge and if they fail to do so on two given dates<\/p>\n<p>         and delays and trial in any manner, their bail will be<\/p>\n<p>         liable to be cancelled for reasons of misuse.<\/p>\n<pre>Fahad.
