The\t appellant applied for an adjustment\nof  the\t  decree,  and\t the  respondent's  application\t for\nexecution was  dismissed.  The\tappellant  then\t obtained  a\ndecree from  the Subordinate  Judge,  Nowgong,\tagainst\t the\nrespondent, and\t in its\t execution, got\t his Gauhati  decree\nattached.  The\t appellant  then  withdrew  his\t adjustment-\napplication.\n     The High  Court allowed  the  respondent's\t appeal\t for\nexecution of  the Gauhati  decree.  The\t Subordinate  Judge,\nGauhati, struck\t off his original execution application from\nthe file.  Thereafter, the  attachment order  ceased  to  be\noperative on  account of  the High  Court's allowance of the\nrespondent's  appeal   in  the\t Nowgong  matter,   and\t the\nrespondent  again  applied  for\t execution  of\tthe  Gauhati\ndecree, but  the Subordinate  Judge, Gauhati,  dismissed the\napplication as\ttime-barred.  The  High\t Court\tallowed\t his\nappeal and  directed the execution to proceed. The appellant\ncontended  before   this  Court\t  that\tattachment   of\t the\nrespondent's decree  did not  amount to\t a 'stay' within the\nmeaning\t of   S.  15  of  the  Indian  Limitation  Act,\t and\ntherefore, his\tsecond application  for execution was barred\nby limitation,\tnot having  been filed within three years of\nthe first  one being  struck off  by the  Subordinate Judge,\nGauhati.\n     Dismissing the appeal, the Court\n^\n     HELD: (1) The order obtained by the appellant attaching\nthe decree  of the  respondent precluded the respondent from\nexecuting the  decree during  the time the attachment was in\nforce. There  was no  question\tof  limitation\tbecause\t the\napplication was\t filed within  three years  from  28  April,\n1964, when  the bar  against execution\twas raised  and\t the\nattachment order ceased to be operative. [627B-C]\n     (2) The  order striking  off the  execution application\nwas mere  consigning it\t to the\t record-room for statistical\npurposes. The  application for execution on 27th July, 1965,\nis a continuation of the old application. [627D-E]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE  JURISDICTION: Civil  Appeal No. 858 of<br \/>\n1968.\n<\/p>\n<p>     From the  Judgment and Decree dated 7-7-67 of the Assam<br \/>\nand Nagaland  High Court  at Gauhati in Misc. Appeal Nos. 36<br \/>\nand 37 of 1966.\n<\/p>\n<p>     Sarjoo Prasad and A. K. Nag for the appellant.<br \/>\n     B. P. Maheshwari for the respondent.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     RAY, C.J.\tThis appeal by certificate is from the order<br \/>\ndated 26 July, 1967 of the High Court of Assam.\n<\/p>\n<p>     The  only\tquestion  in  this  appeal  is\twhether\t the<br \/>\nrespondent&#8217;s  application   filed  on\t27  July,  1965\t for<br \/>\nexecution of  the  decree  obtained  by\t him  is  barred  by<br \/>\nlimitation.\n<\/p>\n<p><span class=\"hidden_text\">626<\/span><\/p>\n<p>     The respondent  on 7  January, 1952  obtained a  decree<br \/>\nagainst the  appellant for  the sum of Rs. 71,980 in a money<br \/>\nsuit filed  in the Court of Subordinate Judge, Gauhati. On 8<br \/>\nDecember,  1956\t  the  respondent   decree-holder  filed  an<br \/>\napplication No.\t 89\/56 for  executing the said decree. On 15<br \/>\nJuly, 1957  the appellant,  the judgment  debtor,  filed  an<br \/>\napplication pleading  adjustment of the decree. On 15 April,<br \/>\n1958 the  judgment debtor  withdrew the said application. On<br \/>\n18 December,  1957 the\tSubordinate Judge  Gauhati dismissed<br \/>\nthe decree-holder&#8217;s application No. 89\/56. The decree-holder<br \/>\npreferred an  appeal. The  High Court  at Gauhati on 1 July,<br \/>\n1959 set  aside the  order  of\tthe  Subordinate  Judge\t and<br \/>\nallowed the appeal for execution of the decree.\n<\/p>\n<p>     Meanwhile on  18 January,\t1958 the  appellant judgment<br \/>\ndebtor in  the Gauhati\tsuit obtained  a decree\t against the<br \/>\nrespondent for\tthe sum\t of Rs. 1,22,000 in the Court of the<br \/>\nSubordinate Judge  at Nowgong. In execution of the decree in<br \/>\nthe Nowgong  suit the appellant on or about 29 January, 1958<br \/>\nobtained an  attachment of the respondent&#8217;s decree passed in<br \/>\nthe Gauhati suit.\n<\/p>\n<p>     On 13  August,  1959  the\tSubordinate  Judge,  Gauhati<br \/>\nstruck off  the execution  application No.  89\/56  from\t the<br \/>\nfile.\n<\/p>\n<p>     The respondent  filed  an\tappeal\tagainst\t the  decree<br \/>\nobtained by  the appellant  in the  Nowgong suit.  The\tHigh<br \/>\nCourt on  28 April  1964 accepted  the appeal  filed by\t the<br \/>\nrespondent and\tdismissed the  Nowgong\tsuit  filed  by\t the<br \/>\nappellant.\n<\/p>\n<p>     On 27  July, 1965\tthe respondent\tfiled an application<br \/>\nfor  execution\tin  the\t Court\tof  the\t Subordinate  Judge,<br \/>\nGauhati. The  appellant preferred  an  objection  contending<br \/>\nthat the  application is  barred by  limitation. On 4 March,<br \/>\n1966  the   Subordinate\t Judge\t dismissed   the   execution<br \/>\napplication as barred by time.\n<\/p>\n<p>     On 26  July, 1967\tthe High  Court accepted  the appeal<br \/>\nfiled by  the  respondent  and\tdirected  the  execution  to<br \/>\nproceed.\n<\/p>\n<p>     The contention  of the  appellant\tis  that  the  order<br \/>\nobtained by  the appellant attaching the respondent&#8217;s decree<br \/>\ndid not amount to a stay within the meaning of section 15 of<br \/>\nthe  Indian   Limitation  Act,\t 1908,\tand  therefore,\t the<br \/>\nrespondent&#8217;s application for execution which was filed on 27<br \/>\nJuly, 1965 was barred by limitation. The appellant contended<br \/>\nthat when  the Subordinate Judge, Gauhati on 13 August, 1959<br \/>\nstruck off  the execution  application of the respondent the<br \/>\nrespondent should  have filed  an application  for execution<br \/>\nwithin three years from that date.\n<\/p>\n<p>     The High  Court referred to the order dated 29 January,<br \/>\n1958 passed  by\t the  Nowgong  Court  attaching\t the  decree<br \/>\nobtained by  the respondent.  The High\tCourt relied  on the<br \/>\nprovisions contained in Order 21 Rule 53 (1) (b) of the Code<br \/>\nof Civil  Procedure and\t held that  the attachment continued<br \/>\nrestraining the\t respondent from  executing the decree until<br \/>\nthe notice  issued by  the Court  attaching the\t decree\t was<br \/>\nrecalled. The Nowgong court did not pass any order recalling<br \/>\nthe<br \/>\n<span class=\"hidden_text\">627<\/span><br \/>\norder. On  1 March,  1958 the  Nowgong court passed an order<br \/>\nwhich was as follows:\n<\/p>\n<blockquote><p>\t  &#8220;Notice  served.  No\tobjection  filed  by  J.  D.<br \/>\n     (meaning thereby  judgment debtor). Heard both parties.<br \/>\n     Execution\tcase   is  struck   off\t for   the  present.<br \/>\n     Attachment to continue until further orders.&#8221;<\/p><\/blockquote>\n<p>     In the  context of\t this order  of attachment passed by<br \/>\nthe Nowgong court the attachment continued until the Nowgong<br \/>\nsuit was  dismissed by the High Court on 28 April, 1964. The<br \/>\nHigh Court  rightly held  that\tthere  was  no\tquestion  of<br \/>\nlimitation because  the application  was filed\twithin three<br \/>\nyears from 28 April, 1964 when the bar against execution was<br \/>\nraised and  the\t order\trestraining  the  respondent  decree<br \/>\nholder from  executing the decree in the Gauhati suit ceased<br \/>\nto be operative.\n<\/p>\n<p>     Another  contention   which  had  been  raised  by\t the<br \/>\nappellant and  repeated here  is that when the Gauhati court<br \/>\non 13  August, 1959  struck off the execution case No. 89\/56<br \/>\nthe execution  application filed on 27 July, 1965 was barred<br \/>\nby time.  The High  Court held\tthat the Gauhati Court on 13<br \/>\nAugust, 1959  merely struck  off the  execution application,<br \/>\nand, therefore,\t the subsequent\t application which  was made<br \/>\nwas a  continuation of\tthe execution  proceedings. The High<br \/>\nCourt held  that striking off the application did not amount<br \/>\nto any order deciding the merits of the application.\n<\/p>\n<p>     The order\tobtained  by  the  appellant  attaching\t the<br \/>\ndecree of  the respondent  in  the  Gauhati  suit  has\tbeen<br \/>\nrightly held  by  the  High  Court  to\thave  precluded\t the<br \/>\nrespondent from\t executing the\tdecree during  the time\t the<br \/>\nattachment was\tin force.  The other  conclusion of the High<br \/>\nCourt that the execution application dated 27 July, 1965 was<br \/>\na continuation\tof the\tearlier application is also correct.<br \/>\nThe order  striking off\t the execution\tapplication has been<br \/>\nrightly construed by the High Court as merely consigning the<br \/>\napplication to the Record Room for statistical purposes. The<br \/>\napplication dated 27 July, 1965 indicates in column 2 as the<br \/>\nrespondent rightly  stated that the previous application for<br \/>\nexecution was  struck off  on 13 August, 1959 because of the<br \/>\norder  of  attachment  passed  by  the\tNowgong\t court.\t The<br \/>\nattachment order  was nullified\t only when  the\t appellant&#8217;s<br \/>\nsuit was  dismissed by the High Court on 28 April, 1964. The<br \/>\nrespondent&#8217;s decree  became executable\tat  that  time.\t The<br \/>\ninescapable conclusion is that the application for execution<br \/>\non 27 July, 1965 is a continuation of the old application.\n<\/p>\n<p>     For these\treasons, the  judgment of  the High Court is<br \/>\naffirmed.
