Justice ANTONY DOMINIC\n\n Dated :28\/01\/2011\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                      -------------------------\n                   W.P (C) No.2767 of 2011\n                      --------------------------\n              Dated this the 28th January, 2011\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioner was the ARD 338 of Ollur Panchayat. On<\/p>\n<p>25.2.2006, a Special Squad of the Civil Supplies<\/p>\n<p>Department inspected the business premises of the<\/p>\n<p>petitioner. On such inspection, it was found that damaged<\/p>\n<p>stock of 25 kg matta rice and 250 kgs of wheat, which were<\/p>\n<p>not good for distribution, were kept in the depot. Various<\/p>\n<p>documents were not produced for inspection, shortage of<\/p>\n<p>stock was found and the licensee was absent and his<\/p>\n<p>brother was conducting the business. On these and other<\/p>\n<p>allegations, after complying all procedural formalities,<\/p>\n<p>Ext.P6 order was issued by the 3rd respondent, cancelling<\/p>\n<p>the appointment of the petitioner.\n<\/p>\n<p>      2.    Petitioner  filed    an     appeal   before the<\/p>\n<p>Commissioner of Civil Supplies. The Commissioner<\/p>\n<p>considered the matter and issued Ext.P7 order, rejecting<\/p>\n<p>the appeal finding that gross irregularities were committed<\/p>\n<p>by the dealer. A revision was filed before the Government,<\/p>\n<p>a copy of which is produced as Ext.P8. That revision was<\/p>\n<p>W.P (C) No.2767 of 2011<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>also rejected as per Ext.P9 order. Although , the statute<\/p>\n<p>did not provide for any review still petitioner filed a review<\/p>\n<p>petition.   It would appear that review petition          was<\/p>\n<p>entertained and an order of stay was initially granted. But<\/p>\n<p>however, the review petition was also rejected by Ext.P10<\/p>\n<p>order.    In the meantime notification was also issued for<\/p>\n<p>appointing    a dealer.   It is challenging    the aforesaid<\/p>\n<p>proceedings the writ petition is filed.\n<\/p>\n<p>      3.   A reading of Ext.P6, the order of the 3rd<\/p>\n<p>respondent, shows     the irregularities committed by the<\/p>\n<p>petitioner. On materials these irregularities were proved<\/p>\n<p>and the nature of irregularities cannot be said to be<\/p>\n<p>anything other than the grave.       In such circumstances,<\/p>\n<p>dealership of the petitioner was ordered to be terminated.<\/p>\n<p>This order of termination was upheld by the appellate and<\/p>\n<p>revisional authority concurrently.\n<\/p>\n<p>      4.
