Meena Devi\nRespondent :- State Of U.P.\nPetitioner Counsel :- Man Bahadur Singh\nRespondent Counsel :- C.S.C.\n\nHon'ble Amreshwar Pratap Sahi,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and the learned standing<br \/>\ncounsel.\n<\/p>\n<p>The contention raised is that the impugned order proceeds on an<br \/>\nerroneous assumption of law. The submission is that the petitioner<br \/>\napplied on 16.6.2006 for the post in question and she was appointed on<br \/>\n31.7.2006. It is urged that prior to this, the petitioner had already<br \/>\nsubmitted her resignation from the office of Member, Gram Panchayat<br \/>\non 19.11.2005.\n<\/p>\n<p>Learned counsel for the petitioner has invited the attention of the Court<br \/>\nto Annexure 1 to the writ petition . It is urged that the said letter of<br \/>\nresignation has been forwarded by the block level authority to the<br \/>\nDistrict Panchayat Raj Officer.\n<\/p>\n<p>Section 12-F of the Panchayat Raj Act,1947 is quoted below:\n<\/p>\n<p>&#8220;12-F Resignation- A Pradhan, Up-Pradhan or a member of Gram<br \/>\nPanchayat may, by writing under his hand addressed to such<br \/>\nauthority as may be prescribed, resign his office and his office<br \/>\nshall thereupon become vacant.&#8221;\n<\/p>\n<p>The rules which have been framed for giving effect to the aforesaid<br \/>\nprovision is Rule 60 which is quoted below:\n<\/p>\n<p>&#8220;Rule 60. Resignations by Pradhan or Up-Pradhan or member or<br \/>\nPanch- The Pradhan or Up-Pradhan or member of Gram<br \/>\nPanchayat or a committee, or a Panch, Sahayak Sarpanch or<br \/>\nSarpanch wishing to resign his office, may do so by either<br \/>\npresenting to the prescribed authority in person or sending to his<br \/>\naddress by registered post, his written resignation signed himself<br \/>\nand attested by the Panchayat Secretary, and upon so presenting<br \/>\nor sending the written resignation the person concerned shall be<br \/>\n deemed to have vacated his office.&#8221;\n<\/p>\n<p>The schedule indicates that the Prescribed Authority for action to be<br \/>\ntaken under Section 12-F is the District Panchayat Raj Officer.\n<\/p>\n<p>From a perusal of the aforesaid provision, there is no room for doubt<br \/>\nthat the petitioner had presented the resignation before the District<br \/>\nPanchayat Raj Officer and it was channelised through the block level<br \/>\nauthority. The resignation comes into effect forthwith and the section as<br \/>\nwell as the rule clearly indicate that it is a unilateral act and is not<br \/>\ndependent upon any bilateral act to be performed by the District<br \/>\nPanchayat Raj Officer. The jural relationship of the petitioner as member<br \/>\nof Gram Panchayat therefore ceases with effect from the date he or she<br \/>\ntenders the resignation before the prescribed authority.\n<\/p>\n<p>Accordingly, the impugned order prima facie cannot withstand the<br \/>\nscrutiny of the law referred to above.\n<\/p>\n<p>Until further orders of this Court, the operation of the impugned order<br \/>\ndated 24.12.2009 shall remain stayed.\n<\/p>\n<p>Learned counsel for the respondents is granted 3 weeks to file counter<br \/>\naffidavit.
