From the grounds of detention, it<br \/>\nappears that only one offence being Prohibition CR No.215 of 2009<br \/>\nunder the provisions of Section 66B, 65AE, 116B and 81 under the<br \/>\nBombay Prohibition Act was registered with Pradhumannagar Police<br \/>\nStation, Rajkot City wherein a quantity of total 48 bottles of<br \/>\nforeign  liquor was found from the possession of the detenue. On the<br \/>\nbasis of registration of this case, the detaining authority held that<br \/>\nthe present detenue was carrying on activities of selling liquor<br \/>\nwhich is harmful to the health of the public. It is held by the<br \/>\ndetaining authority that as the detenue is indulged in illegal<br \/>\nactivities, it is required to restrain the detenu from carrying out<br \/>\nfurther illegal activities, i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance on the above registered offence and<br \/>\nstatements of unnamed witnesses.  In the opinion of this Court, the<br \/>\nactivities of the detenue can, by no stretch of imagination, be said<br \/>\nto be disturbing the  public order.  It is seen from the grounds<br \/>\nthat a general statement that has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health.  In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which  are mentioned in the order are in reference to the<br \/>\nsituation of  law and order  and not  public order .<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of  law and<br \/>\norder  and not  public order .\n<\/p>\n<p>5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 10.11.2009<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
