HEMA, J.\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n                      B.A. No. 798 of 2009\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n          Dated this the 20thday of February, 2009\n\n                            O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections       447, 294(b)<\/p>\n<p>and 326 IPC. According to prosecution, on 16-1-2009 at about<\/p>\n<p>7.30 p.m. petitioner trespassed into the property of de facto<\/p>\n<p>complainant, abused him in filthy language and assaulted de<\/p>\n<p>facto complainant by using iron rod and inflicted a fracture on<\/p>\n<p>the forearm and thereby committed various offences.<\/p>\n<p>       3. Learned counsel for petitioner submitted that there<\/p>\n<p>was some quarrel between petitioner and de facto complainant<\/p>\n<p>on account of a boundary dispute. No incident            take place.<\/p>\n<p>Though an incident is alleged to have occurred on 16-1-2009,<\/p>\n<p>petitioner went to the hospital only on 17-1-2009. If there is a<\/p>\n<p>fracture, it is highly improbable that he would wait till the next<\/p>\n<p>day to go to hospital. The distance between the hospital and the<\/p>\n<p>police station is 5 k.m. But, there is a delay in registration of the<\/p>\n<p>crime. The crime was registered only on 19-1-2009. Petitioner is<\/p>\n<p>prepared to abide by any condition.         In such circumstances,<\/p>\n<p>petitioner may be granted anticipatory bail, it is submitted.<\/p>\n<p>       4. This petition is opposed. Petitioner Learned Public<\/p>\n<p>Prosecutor submitted that there is a delay in registering the<\/p>\n<p>BA 798\/09                        -2-\n<\/p>\n<p>crime and it is explained. De facto complainant wanted to<\/p>\n<p>consult his son to go to hospital and that is why the delay was<\/p>\n<p>caused. The First Information Statement was recorded from the<\/p>\n<p>hospital. Recovery of weapon is to be effected.<\/p>\n<p>       5. On going through the case diary, it is seen from the<\/p>\n<p>wound certificate that petitioner sustained a fracture to the right<\/p>\n<p>forearm. Deformity of the right wrist was noted therein on 17-1-<\/p>\n<p>2009 at 11 a.m.     but no other injury is noted. X ray shows<\/p>\n<p>fracture on the right forearm. The incident stated to have<\/p>\n<p>occurred on 16-1-2009 at 7.30 p.m.<\/p>\n<p>       6. On hearing both sides and on going through the case<\/p>\n<p>diary, I am satisfied that anticipatory bail can be granted to<\/p>\n<p>petitioner on conditions. Hence, the following order is passed:-<\/p>\n<blockquote><p>       (1) Petitioner shall surrender before the Magistrate<\/p>\n<p>            Court concerned within seven days from today<\/p>\n<p>            and he shall be released on bail, on his<\/p>\n<p>            executing a bond for Rs. 25,000\/- with two<\/p>\n<p>            solvent sureties each, for the like amount, to<\/p>\n<p>            the satisfaction of the learned Magistrate, on<\/p>\n<p>            the following conditions:-\n<\/p><\/blockquote>\n<pre>            i)   Petitioner shall     report before the\n\nBA 798\/09                      -3-\n\n<\/pre>\n<blockquote><p>                Investigating Officer within four days<\/p>\n<p>                from the date of release on bail and co-<\/p>\n<p>                operate with the investigation.<\/p>\n<\/blockquote>\n<blockquote><p>          ii)  Petitioner   shall not   intimidate   or<\/p>\n<p>                influence any witness   or commit any<\/p>\n<p>                offence while on bail.\n<\/p><\/blockquote>\n<blockquote><p>     This petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                         K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sambasivan vs State Of Kerala on 20 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 798 of 2009() 1.
