4. In the background of the contention putforth<\/p>\n
by the learned Counsel for the petitioner that he was
\nthe senior most lecturer during March 1998 and was<\/p>\n
therefore eligible to be promoted to the post<\/p>\n
Principal as indicated in Clause (vi) of the-goVern’i’nei’i.tT’ i.<\/p>\n
order dated 2 \/ 8 \/ 1995, the same_has_bee_n”by_ 0″ V<\/p>\n
the 15′ respondent. A further”-pperusalhogf’  <\/p>\n
impugned in this petition’ll\\Jsioi1V_ld indicate 15:-_~_’<\/p>\n
respondent has taken note—-oi”v–thegA fact”–th.at..:\u00a7 one Sri<\/p>\n
Sannabornmaji had  asevl:l_in:\u00a5Charge Principal<\/p>\n
and ejienllltlioittghlproposalliztiaslputforth for appointing
\nhim  rejected on 7\/ 3 \/ 2000, no<\/p>\n
fresh. proposal was ina\u00e9ie by the Management. In this<\/p>\n
 13* respondent has also noticed that even<\/p>\n
 petitioner was entitled to be appointed as<\/p>\n
 in the absence of proposal, appointment<\/p>\n
 coguldziiot be made which indicated that the lapse of the<\/p>\n
0′ =.man’agen1ent had prejudiced the petitioner. Despite<\/p>\n

noticing that as on the date of passing of order by the
\n181 respondent, petitioner had attained the age of<\/p>\n
superannuation, has thought it fit that no <\/p>\n
could be issued to the 3rd respondent, ManAagen::i:ent’;~  ‘<\/p>\n
appoint the petitioner as Prineipa_.1r <\/p>\n
5. In my view, by the  <\/p>\n
respondent in fact has Come’.t_o~a prinia faeie eoneiusion V<\/p>\n
that the petitioner was entitIed.’Vp_to’uth_e reiiea but could
\nnot be granted only beeaiiseihmtained the age of<\/p>\n
superannuation,  in dciijteunistances, the 154<\/p>\n
respondent  heard the 3rd respondent and<\/p>\n
come to a”e_o13e1us_ion  whether the right which had<\/p>\n
 ace1*tieVdi’~to thne”i-ptetitiponer had been unjustiy denied to<\/p>\n
   ___After recording a \ufb01nding on that aspect<\/p>\n
iofpthe  the 15′ respondent had Come to the<\/p>\n
 eoneitisiionvdithat the right of the petitioner had been<\/p>\n
  denied though he was iegaliy entitied to,<\/p>\n
i  petitioner would have been entitled to the monetary<\/p>\n
\u00a32<\/p>\n

benefits, which he would have earned if, in fact, h-e__ had<\/p>\n
been appointed as the Principal when the.A..r’i\u00a7_\u00a7ht”o:’–had<\/p>\n
accrued to him. Hence this aspect  <\/p>\n
requires re–considerat1’on by the””‘I>*3i.respondent, “a=fte’r<\/p>\n
providing opportunity to the res’.poAn’dventn.ur\ufb02n’–..<\/p>\n
consideration, if the 15′ ‘r,\u00e9”sp0nd\u20acn.t’vairrixfesat a<\/p>\n
Conclusion that the ‘right   to the
