Jain, J.  <\/p>\n<p> 1. This Second Appeal raises a short legal<br \/>\nquestion &#8212; Whether a civil suit challenging the<br \/>\nrateable value assessed by the Municipal Corporation<br \/>\nof Delhi under the provisions of Delhi Municipal<br \/>\nCorporation Act, 1957 isbarredin view of the<br \/>\nprovisions of Section 169 of the Act?\n<\/p>\n<p> 2. The appellants herein had filed four<br \/>\nsuits for permanent injunction against the<br \/>\nrespondent-MCD forrestraining them from recovering<br \/>\nproperty tax with respect to property No.450 to 453,<br \/>\nWard No.V,Chandni Chowkat a rateablevalue of<br \/>\nRs.24,400\/-w.e.f.1.4.75. It was averred that the<br \/>\nassessment of the aforesaid rateable value was illegal<br \/>\nandwithout jurisdiction and in any case excessive in<br \/>\nas much as the standard rent and agreed rent of the<br \/>\npremises was much less. The suits were contested by<br \/>\nthedefendant-MCD inter alia on the ground that the<br \/>\nsuits were not maintainable in view of the provisions<br \/>\nof Sections 169-170 and 477-478 of the Delhi Municipal<br \/>\nCorporation Act and the civil court had no<br \/>\njurisdiction to try thesuit.The trial court<br \/>\nanswered both the objections in negative and decreed<br \/>\nthe suits of the appellant and restrained the MCD from<br \/>\nrecovering property tax for the year 1976-77 up to the<br \/>\nperiod ending 31st March, 1980 at a rateable value<br \/>\nhigher than Rs.6610\/- per annum.\n<\/p>\n<p> 3. Aggrieved by the said judgment and decree<br \/>\nof the trial court, the MCD filed an appeal. The<br \/>\nappellate court allowed the appeal and dismissed the<br \/>\nsuits primarily on the ground that jurisdiction of the<br \/>\ncivil court was barred in a matter relating to the<br \/>\nassessment of house tax particularly when the relief<br \/>\nsought by the plaintiff could be obtained by filing a<br \/>\nstatutory appeal which was the proper and efficacious<br \/>\nremedy available under the statute.\n<\/p>\n<p>4. I have heard learned counsel for the<br \/>\nparties and have given my thoughtful consideration to<br \/>\ntheir respective submissions. At the outset, learned<br \/>\ncounsel for the appellant has submitted that the above<br \/>\nquestion of law has been considered and answered by a<br \/>\nDivision Bench of this Court in the case of Ganga Ram<br \/>\nHospital Trust Vs.MCD 92(2001) DLT 775. The court<br \/>\non a consideration of the provisions of the DMC Act<br \/>\nhas held as under :-\n<\/p>\n<p>  &#8220;Section 169 provides for a<br \/>\nremedy ofappeal against levy or<br \/>\nassessment of any tax under the Act while<br \/>\nSection 170 lays down conditions subject<br \/>\nto which the right of appeal conferred by<br \/>\nSection 169 can be exercised. Neither of<br \/>\nthese two sections contain any provision<br \/>\nbarring a civil suit to challenge levy<br \/>\nand assessment of tax under the Act. At<br \/>\nbest it may be argued that in view of the<br \/>\nremedy of appeal provided under Section<br \/>\n169 of theAct aparty should have<br \/>\nrecourse tothe said remedy. Butthe<br \/>\nparty filing a civil suit to challenge<br \/>\nthe levy and assessment of tax under the<br \/>\nAct may like to urge that the levyand<br \/>\nassessment of tax is not in accordance<br \/>\nwiththe Act or is violative ofthe<br \/>\nprovisions of the Act. In other words it<br \/>\nmay be the case of a plaintiff thatthe<br \/>\nAuthorities under the Act have not acted<br \/>\nin accordance with the provisions of the<br \/>\nAct while levying and assessing tax and,<br \/>\ntherefore, it is entitled to exercise its<br \/>\ninherent right to challenge such a levy<br \/>\nand assessment by way of a civil suit.<br \/>\nAvailability of an alternative remedy may<br \/>\nbe treated as a bar by the Court while<br \/>\nexercising its writ jurisdiction because<br \/>\nwritjurisdiction under Article 226 of<br \/>\nthe Constitution of India is a matter of<br \/>\nexercise of discretionary jurisdiction of<br \/>\nthe Court but it is not the same case<br \/>\nwhile entertaining a civil suit.<br \/>\nExercise ofjurisdiction to entertain<br \/>\ncivil suit is not a discretionary matter<br \/>\nbefore the Civil Court. A Civil Court<br \/>\nmay reject the plaint as per law or<br \/>\ndismiss a civil suit on merits. It<br \/>\ncannot refuse to entertain the suit<br \/>\nunless barred by law. The DMC Act does<br \/>\nnot contain any such bar to a civil suit<br \/>\nin matters of levy and assessment of<br \/>\ntax.&#8221;\n<\/p>\n<p> xxxx xxxx  <\/p>\n<p> &#8220;The result ofthe above<br \/>\ndiscussion is that the impugned judgment<br \/>\nof the Trial Court holding that a civil<br \/>\nsuit is not maintainable cannot be<br \/>\nsustained. The finding of the Trial<br \/>\nCourt on the preliminary issue is hereby<br \/>\nset aside. It is held that a civil suit<br \/>\nto challenge levy and assessment oftax<br \/>\nis not barred in view of Section 169 of<br \/>\nthe Act. A civil suit in such cases is<br \/>\nmaintainable. Itis, however, a<br \/>\ndifferent matter whether on merits a<br \/>\nplaintiff is able to make out a case in<br \/>\nits favor in the suit. On question of<br \/>\nmerits of the controversy in the suit we<br \/>\nsay nothing. The Trial Court dismissed<br \/>\nthe suit on the threshold holding it is<br \/>\nnot maintainable and, therefore, we have<br \/>\nonly considered the question of<br \/>\nmaintainability of a civil suit in this<br \/>\nappeal. The appeal is allowed andthe<br \/>\nimpugned judgment of the Trial court is<br \/>\nset aside. The suit is remanded back to<br \/>\ntheTrialCourtfor decision in<br \/>\naccordance with law. In the factsand<br \/>\ncircumstances of the case, there will be<br \/>\nno order as to costs.&#8221;\n<\/p>\n<p> 5. In view of the legal position emerging<br \/>\nfrom the above decision, the judgment passed by the<br \/>\nfirst appellate court holding that the jurisdiction of<br \/>\nthecivil court to entertain and try the matter<br \/>\nrelating to the assessment of house tax is barred,<br \/>\ncannot be sustained and is liable to be set aside.<br \/>\nHowever, as the judgment of the First Appellate court<br \/>\nis confined only to the maintainability of the suit<br \/>\nandno finding was rendered on the merits of the<br \/>\nappeal though the impugned judgment and decree of the<br \/>\ntrial court was sought to be challenged on merits also<br \/>\non several grounds, this court is of the opinion that<br \/>\ntheappealfiled by the MCD should be heard and<br \/>\ndisposed of on merits.\n<\/p>\n<p> 6.In the result this appeal succeeds and is<br \/>\nhereby allowed and the impugned judgment and decree of<br \/>\ntheFirst Appellate court dated 9.3.98 is hereby set<br \/>\naside and the matter is remanded back to the First<br \/>\nAppellate court to dispose of the appeal of the MCD on<br \/>\nmerits.
