Kochar, J.<\/p>\n<p>1. All these three appeals have been filed against the same judgment of conviction and sentence, hence taken up together and dispose of by this common judgment.\n<\/p>\n<p>2. For taking exception to the order of conviction and sentence passed against the appellants by learned Addl. Sessions Judge, Agar in the master of ST. No. 134\/1997, dated 6-3-1999, the appellants have approached this Court by preferring this appeal. Learned Judge had convicted the appellants for the offence punishable under Sections 302\/149 and 323\/149 of the IPC and sentenced each appellant to undergo R.I. for life and six months respectively.\n<\/p>\n<p>3. The prosecution case in short for disposal of this appeal is that sister of appellant No. 2 Mangilal named Shantibai was married with Gokuldas, the brother of complainant Narsingdas (P.W. 1). There was no cordial relation between the spouses. Some days prior to the date of incident, Shantibai was not available at the house of Gokuldas. Rest of the appellants were close relations of appellant No. 2 Mangilal. All the appellants were having ill-will with the family of Gokuldas. On the date of incident, i.e., 18-6-1997 at 2.30 p.m. in the forest of Village Gotda at the well of complainant Narsingdas, he and son Sohandas aged 12 years were causing their cattle to drink water. At that juncture, appellant No. 1 Badrilal and appellant No. 2 Mangilal reached over there having lathi in their possession. They asked for tobacco from complainant Narsingdas and one of them drank water. At that moment other appellants also reached over there. They all were having lathis in their possession. They surrounded the complainant Narsingdas and his son, deceased Sohandas. Thereafter inquired about sister of Mangilal, the wife of brother of complainant Narsingdas and also started beating complainant Narsingdas and his son Sohandas. Specific over-tact was made by Badrilal on the person of complainant Narsingdas. Complainant Narsingdas raised cry which attracted his son Vishnu (P.W. 3). The appellants seeing Vishnu, fled away from the place of incident. Sohandas, boy aged about 12 years died on the spot. Complainant Narsingdas went to village and informed about the incident to the brothers of Village Choukidar. According to the complainant, before 15 days from the date of incident Shantibai wife of his brother Gokuldas left her house and went to her father&#8217;s house because of which the appellants having grievance and assaulted the complainant and his son.\n<\/p>\n<p>4. The information about the incident was given to the police by Vishnu (P.W. 3) who had only seen the appellants running away from the spot. On information given by Vishnu, police party reached in the village and Nand Kishore (P.W. 11), ASI recorded Dehati Nalishi (Ex. P-1) at the instance of Narsingdas. Thereafter prepared inquest of the dead body of Sohandas and also sent the same for post-mortem. Post-mortem was performed by Dr. N.K. Patel (P.W. 10). His report is Ex. P-22. After necessary investigation and arrest of the appellants, charge-sheet was filed before the Committal Court.\n<\/p>\n<p>5. The appellants have denied the charges. According to appellant Ram Prasad (since dead), he alongwith his son, appellant No. 2 Mangilal and one more person Gopal went to the police station Chapiheda and lodged the report of Gumshudgi of Shantibai which was recorded in Rojnamcha Sanha No. 565 at 2.00 p.m. (Ex. D-1-C). They were not present on the scene of occurrence as alleged by the complainant. All the appellants have denied the charges and claimed trial. The learned Trial Court, after examining the prosecution and defence witnesses, convicted the appellants as mentioned above.\n<\/p>\n<p>6. Having heard the learned Counsel for parties and after perusing the entire record, we are of the opinion that as per statement of Narsingdas (P.W. 1), the solitary injured eye witness of the incident and medical evidence of Dr. N.K. Patel (P.W. 10), only appellant No. 1 Badrilal could be held liable for commission of murder of deceased Sohandas, a boy aged 12 years and appellant No. 2 Mangilal is responsible for causing simple injury to Narsingdas (P.W.I).\n<\/p>\n<p>7. Narsingdas (P.W. 1) has testified in his statement that on the date of incident, he and his son Sohanlal reached at their well to cause their cattle to drink water. At that time appellant No. 1 Badrilal and No. 2 Mangilal reached over there and they took tobacco from him. After chewing tobacco they drank water. Thereafter both Badrilal and Mangilal started beating him and his son Sohanlal. The rest of the appellants reached over there after some time. They all were also having lathi and Salia (wooden log). They all also started beating to him and also to his son. He raised cry upon which his son Vishnu rushed towards the scene of occurrence from side of village. He (Narsingdas) also ran away towards the village while raising cry. During this period, all the accused persons fled away. After reaching in the village, this witness went to Village Choukidar and informed about the incident. This witness has further testified that sister of appellant No. 2 Mangilal named Shantibai was married with his brother Gokuldas and she left their house since last 15 days from the date of incident because of this, the appellants were annoyed and assaulted them. The simple information was given in the police station by his son Vishnu and after arrival of police in the village, this witness lodged the report; Dehati Nalishi (Ex. P-1). In cross-examination, paragraph six this witness has specifically stated that appellant No. 2 Mangilal assaulted him whereas appellant No. 1 Badrilal assaulted deceased Sohanlal and both have dealt two blows on this witness and deceased. General and omnibus allegations have been levelled by this witness regarding participation and assault by all the appellants but his this version is not corroborated by the medical evidence of Dr. N.K. Patel (P.W. 10).\n<\/p>\n<p>8. According to the evidence of Dr. N.K. Patel (P.W. 10), deceased sustained externally one lacerated wound on front region turning towards the right side on the head. Because of this injury, there was fracture of frontal bone. The brain matter was visible. Second injury was also lacerated wound on right side of the head near right eye brow. Underneath this injury, there was fracture. On internal examination, there was rupture of embrace of right and frontal lobe of the brain. There was damage to brain also. Deceased died because of injury and damage to brain within 24 hours from the time of post-mortem. All the injuries were ante mortem in nature and sufficient for causing death. His post mortem report is Ex. P-22. In cross-examination again this witness has stated that deceased suffered only two injuries and both were on the head and underneath the external injuries, internal injuries were also present. Apart from these two injuries, no other injuries were noticed externally or internally on the person of deceased. This witness has also examined Narsingdas (P.W. 1) and found one swelling on front side of the head and another swelling on the left shoulder. Both the injuries were caused by hard and blunt object.\n<\/p>\n<p>9. Looking to the medical evidence and statement of Narsingdas (P.W. 1), in para six regarding causing two blows on the person of deceased Sohanlal by appellant No. 1 Badrilal and his person by appellant No. 2 Mangilal, is amply proved. These injuries were caused by both the appellants. At that time, appellant No. 3 Gokul, No. 4 Durga Prasad, No. 5 Ram Prasad, and No. 6 Manohar were not present. They reached lateron and it appears that they did not assault the deceased as well as witness Narsingdas (P.W. 1) and that is why Narsingdas (P.W. 1) levelled general and omnibus allegations against them.\n<\/p>\n<p>10. We have carefully scrutinized the statement of Narsingdas (P.W. 1) because he is the father of the deceased and interested witness. Against the appellants prosecution also adduced only solitary witness Narsingdas (P.W. 1), The testimony of Narsingdas (P.W. 1) would not be brushed aside only because he is the father of the deceased and is the solitary witness of the incident. His presence on the scene of occurrence is amply proved because of injury sustained by him in the same incident. He being the father of the deceased would not leave the real culprit but at the same time immunity could not be attached to him for implicating innocent persons along with the real culprits. Therefore, it is the duty of the Court to separate grain from the chaff. The maxim &#8220;Falsus in Una Falsus in Omnibus&#8221; is not applicable in our country.\n<\/p>\n<p>11. Therefore, on the basis of the statement of Narsingdas (P.W. 1) and the medical evidence, we are of the considered view that prosecution is successfully proved the participation of appellant No. 1 Badrilal and appellant No. 2 Mangilal in the incident of causing injury to deceased Sohanlal and witness Narsingdas (P.W. 1).\n<\/p>\n<p>12. Now the next question for determination is whether both the appellants could be held responsible for commission of murder of Sohanlal with the help of Section 34 of the IPC. Though they were not charged with Section 34 of the IPC but law is well established that if the accused persons are charged for commission of any offence with the aid of Section 149 of the IPC they can be convicted for commission of the said offence with the aid of Section 34 if prosecution is failed to prove the formation of unlawful assembly for commission of the particular offence. In the present case, on the basis of the statement of Narsingdas (P.W. 1), appellant No. 1 Badrilal and appellant No. 2 Mangilal reached at his well. They asked tobacco. They enjoyed tobacco and thereafter drank water and then all of a sudden started beating them. There is no evidence on record that they had any premeditation, pre-meeting of mind or pre-plan for committing murder of son of Narsingdas (P.W. 1) named Sohanlal. Both the appellants would not have common intention to commit murder of a boy aged 12 years. Therefore, both can not be held responsible for commission of murder of Sohanlal aged 12 years with the aid of Section 34 of the IPC.\n<\/p>\n<p>13. In the result, on the basis of foregoing discussion on fact and law, no case is made out against appellant No. 3 Gokul, No. 4 Durga Prasad and No. 5 Manohar. Therefore, they are acquitted from all charges. They are on bail. Their bail bond and surety bond stand discharged.\n<\/p>\n<p>14. Appellant No. 1 Badrilal dealt a lathi blow on the head of 12 year old boy Sohanlal not only once but twice; that shows that he intended to cause injury on the head and the said injury proved sufficient in ordinary course of nature to cause death. The nature of external and internal injury as defined by Dr. N.K. Patel (P.W. 1) on the person of deceased are also sufficient to prove that after sustaining the said injury deceased could not survive at any cost. Therefore, the case of appellant No. 1 Badrilal would squarely falls within the definition of Section 300 Clause Three punishable under Section 302 of the IPC. Thus, he is convicted under Section 302 of the IPC, sentenced to R.I. for life instead of his conviction under Section 302\/149 of the IPC. He is acquitted from the charge of causing simple injury to Narsingdas (P.W. 1). His conviction and sentence under Section 323\/249 of the IPC are hereby set aside. The conviction of appellant No. 2 Mangilal under Section 302\/149 of the IPC is hereby set aside. He stands convicted only under Section 323 of the IPC instead of Section 323\/149 of the IPC and the sentence as awarded by the Trial Court is hereby maintained. He is in jail and served out more than six months jail sentence. Therefore, Trial Court is directed to release him forthwith if not required in any other criminal case.\n<\/p>\n<p>15. The appeals arc allowed in part on the terms indicated herein-above.\n<\/p>\n<p>16. Original judgment be retained in Cr. Appeal No. 421\/1999 and a copy whereof be placed in connected Cr. Appeal No. 451\/1999 and Cr.
