Kundan Singh son of Sambhu Singh\n                                                 Versus\n                                         The State Of Bihar\n                                               -----------\n<\/pre>\n<p>2.   16.8.2011              Heard learned counsel for the petitioners and the<\/p>\n<p>                 State.\n<\/p>\n<p>                            The petitioners are apprehending their arrest in a<\/p>\n<p>                 case registered under Sections 147, 148, 149, 341, 323, 504,<\/p>\n<p>                 379, 324 and 307 of the Indian Penal Code.\n<\/p>\n<p>                          Considering that there is a counter version of the<\/p>\n<p>                 occurrence which took place on the day of Holi and the<\/p>\n<p>                 injuries sustained on the five injured were simple in nature,<\/p>\n<p>                 let the petitioners above named be released on anticipatory<\/p>\n<p>                 bail in the event of arrest or surrender before the learned<\/p>\n<p>                 court below within a period of 12 weeks from today in<\/p>\n<p>                 connection with Risiup P.S. case No.17 of 2011 on furnishing<\/p>\n<p>                 bail bonds of Rs.10,000\/- (Ten thousand) with two sureties of<\/p>\n<p>                 the like amount each to the satisfaction of Chief Judicial<\/p>\n<p>                 Magistrate, Aurangabad, subject to the conditions as laid<\/p>\n<p>                 down under Section 438(2) of the Code of Criminal<\/p>\n<p>                 Procedure as also conditions (i) That one of the bailor will be<\/p>\n<p>                 a close relative of the petitioners who will give an affidavit<\/p>\n<p>                 giving genealogy as to how he is related with the petitioners.<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            The bailor will undertake to furnish information to the Court<\/p>\n<p>            about any change in address of the petitioners. (ii) That the<\/p>\n<p>            affidavit shall clearly state that the petitioners are not an<\/p>\n<p>            accused in any other case and if they are they shall not be<\/p>\n<p>            released on bail, (iii) That the bailor shall also state on<\/p>\n<p>            affidavit that he will inform the court concerned if the<\/p>\n<p>            petitioners are implicated in any other case of similar nature<\/p>\n<p>            after their release in the present case and thereafter the court<\/p>\n<p>            below will be at liberty to initiate the proceeding for<\/p>\n<p>            cancellation of bail on ground of misuse, (iv) That the<\/p>\n<p>            petitioners will give an undertaking that they will receive the<\/p>\n<p>            police papers on the given date and be present on date fixed<\/p>\n<p>            for charge and if they fail to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, their bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (v) That the petitioners will<\/p>\n<p>            be well represented on each date if they fail to do so on two<\/p>\n<p>            consecutive dates, their bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/                       ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sanjay Singh @ Ghubar Singh @ &#8230; vs The State Of Bihar on 16 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
