In\u00a0our\u00a0order\u00a0dated\u00a020\u00a0August\u00a02010,\u00a0we\u00a0had\u00a0directed\u00a0the\u00a0branch\u00a0manager\u00a0<\/p>\n<p>concerned \u00a0 to \u00a0 appear \u00a0 before \u00a0 us \u00a0 and \u00a0 explain \u00a0 the \u00a0 reasons \u00a0 for \u00a0 the \u00a0 delayed\u00a0<\/p>\n<p>response\u00a0to\u00a0the\u00a0RTI\u00a0application.\u00a0It\u00a0is\u00a0to\u00a0be\u00a0noted\u00a0that\u00a0the\u00a0RTI\u00a0application\u00a0had\u00a0<\/p>\n<p>been\u00a0preferred\u00a0on\u00a027\u00a0February\u00a02009\u00a0while\u00a0the\u00a0CPIO\u00a0had\u00a0replied\u00a0on\u00a04\u00a0May\u00a02009\u00a0<\/p>\n<p>denying\u00a0the\u00a0information\u00a0by\u00a0citing\u00a0the\u00a0exemption\u00a0provision\u00a0contained\u00a0in\u00a0Section\u00a0<\/p>\n<p>8(1)\u00a0(d)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act.\u00a0We\u00a0had\u00a0dealt\u00a0with\u00a0this\u00a0matter\u00a0in\u00a0<\/p>\n<p>our\u00a0order\u00a0dated\u00a020\u00a0July\u00a02010\u00a0and\u00a0had\u00a0directed\u00a0the\u00a0CPIO\u00a0to\u00a0provide\u00a0the\u00a0desired\u00a0<\/p>\n<p>information\u00a0to\u00a0the\u00a0Appellant\u00a0in\u00a0view\u00a0of\u00a0the\u00a0fact\u00a0that\u00a0the\u00a0Appellant\u00a0had\u00a0produced\u00a0<\/p>\n<p>a\u00a0proper\u00a0authorisation\u00a0from\u00a0the\u00a0holder\u00a0of\u00a0the\u00a0account\u00a0right\u00a0during\u00a0the\u00a0hearing\u00a0<\/p>\n<p>itself.\n<\/p>\n<\/p>\n<p>3.        Today,\u00a0during\u00a0the\u00a0hearing,\u00a0the\u00a0branch\u00a0manager\u00a0concerned\u00a0was\u00a0present\u00a0<\/p>\n<p>CIC\/SM\/A\/2009\/001398<br \/>\n and\u00a0submitted\u00a0that\u00a0the\u00a0desired\u00a0information\u00a0had\u00a0already\u00a0been\u00a0provided\u00a0to\u00a0the\u00a0<\/p>\n<p>Appellant \u00a0 in \u00a0 compliance \u00a0 of \u00a0 our \u00a0 order \u00a0 although \u00a0 he \u00a0 did \u00a0 not \u00a0 produce \u00a0 any\u00a0<\/p>\n<p>documentary\u00a0evidence\u00a0in\u00a0support\u00a0of\u00a0this\u00a0claim.\u00a0In\u00a0fact,\u00a0he\u00a0had\u00a0no\u00a0record\u00a0or\u00a0<\/p>\n<p>document\u00a0to\u00a0show\u00a0in\u00a0support\u00a0of\u00a0any\u00a0of\u00a0his\u00a0claims.\u00a0He\u00a0submitted\u00a0that\u00a0although\u00a0<\/p>\n<p>the\u00a0application\u00a0had\u00a0been\u00a0received\u00a0in\u00a0the\u00a0branch,\u00a0it\u00a0had\u00a0been\u00a0transferred\u00a0to\u00a0the\u00a0<\/p>\n<p>CPIO\u00a0in\u00a0the\u00a0Zonal\u00a0office\u00a0for\u00a0further\u00a0necessary\u00a0action\u00a0although,\u00a0once\u00a0again,\u00a0he\u00a0<\/p>\n<p>had\u00a0no\u00a0documentary\u00a0evidence\u00a0to\u00a0support\u00a0his\u00a0claim.\u00a0He\u00a0admitted\u00a0that\u00a0there\u00a0was\u00a0<\/p>\n<p>a\u00a0delay\u00a0and\u00a0prayed\u00a0for\u00a0pardon.\n<\/p>\n<\/p>\n<p>4.      We\u00a0carefully\u00a0considered\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0RTI\u00a0application\u00a0and\u00a0noted\u00a0<\/p>\n<p>that\u00a0the\u00a0Appellant\u00a0had\u00a0wanted\u00a0details\u00a0about\u00a0the\u00a0loan\u00a0account\u00a0of\u00a0a\u00a0third\u00adparty\u00a0<\/p>\n<p>customer\u00a0of\u00a0the\u00a0bank.\u00a0Although\u00a0belated,\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0CPIO\u00a0was\u00a0right\u00a0that\u00a0<\/p>\n<p>such\u00a0information\u00a0could\u00a0not\u00a0be\u00a0disclosed.\u00a0However,\u00a0this\u00a0decision\u00a0could\u00a0have\u00a0<\/p>\n<p>been\u00a0sent\u00a0to\u00a0the\u00a0Appellant\u00a0well\u00a0within\u00a0the\u00a0stipulated\u00a0time\u00a0period.\u00a0By\u00a0not\u00a0doing\u00a0<\/p>\n<p>so\u00a0and\u00a0by\u00a0not\u00a0forwarding\u00a0the\u00a0RTI\u00a0application\u00a0to\u00a0the\u00a0designated\u00a0CPIO\u00a0in\u00a0time,\u00a0<\/p>\n<p>the\u00a0branch\u00a0manager\u00a0delayed\u00a0the\u00a0response\u00a0by\u00a0nearly\u00a0a\u00a0month.\u00a0We\u00a0strongly\u00a0warn\u00a0<\/p>\n<p>him\u00a0to\u00a0be\u00a0careful\u00a0in\u00a0future\u00a0and\u00a0not\u00a0sit\u00a0over\u00a0RTI\u00a0applications\u00a0but\u00a0to\u00a0act\u00a0promptly.\u00a0<\/p>\n<p>The \u00a0 Bank\u00a0 needs\u00a0 to \u00a0 sensitise \u00a0 its \u00a0 officers \u00a0 posted \u00a0 in \u00a0 the \u00a0 branches\u00a0 about \u00a0 the\u00a0<\/p>\n<p>responsibility\u00a0in\u00a0respect\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act.<\/p>\n<p>5.      The\u00a0case\u00a0is\u00a0disposed\u00a0of\u00a0with\u00a0the\u00a0above\u00a0observations.<\/p>\n<p>6.
