Badiani in M.C.A. No.3584\/2010 and<br \/>\nsubsequently in the main matter being Special Civil Application<br \/>\nNo.5677 of 2009, as under :\n<\/p>\n<p>1\/1.\tHarshidaben<br \/>\nA. Badiani<\/p>\n<p>\tw\/o. Late<br \/>\nShri Ashokbhai V. Badiani<\/p>\n<p>1\/2\tYash<br \/>\nAshokbhai Badiani<\/p>\n<p>1\/3\tRonak<br \/>\nAshokbhai Badiani<\/p>\n<p>\tAll<br \/>\nresiding at &#8220;Krishna Bhuvan&#8221;,<\/p>\n<p>\tNr.Bhid<br \/>\nBhanjan Gate, <\/p>\n<p>\tOpp. Bonny<br \/>\nTravels,<\/p>\n<p>\tJamnagar.\n<\/p>\n<p>[3]\tThe<br \/>\napplication has been taken out on the ground that the original<br \/>\nrespondent No.1 expired during the pendency of M.C.A. No.3584 of 2010<br \/>\nand that therefore, it becomes necessary to join and implead the<br \/>\nheirs and legal representatives of the said original respondent No.1<br \/>\nin M.C.A. No.3584 of 2010.\n<\/p>\n<p>[4]\tHaving<br \/>\nregard to the submissions by learned senior counsel and the averments<br \/>\nmade in the application, by order dated 10.05.2011 the application<br \/>\nwas admitted and notice was issued. It is reported that the process<br \/>\nhas been served to all the respondents, however, no one has entered<br \/>\ntheir appearance and  any objection has not been  filed and,<br \/>\ntherefore, the relief as prayed for in paragraph No.8(b) is granted.<br \/>\nThe applicants are permitted to amend the cause-title of M.C.A.<br \/>\nNo.3584 of 2010 to substitute the respondent No.1 and implead his<br \/>\nheirs and legal representatives as per the details mentioned in<br \/>\nparagraph No.8(b) of the Civil Application No.4601 of 2011.
