The petitioner is branded as  bootlegger .\n<\/p>\n<p>2.\tHeard<br \/>\nMr NP Thakkar, learned advocate for the petitioner and Mr KL Pandya,<br \/>\nlearned AGP for the respondents. Affidavit in reply filed by<br \/>\nrespondent No.2   Commissioner of Police, Ahmedabad City has been<br \/>\ntaken into consideration.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner came to be detained as  bootlegger  on his involvement<br \/>\nin two cases arising under the Bombay Prohibition Act.\n<\/p>\n<p>4.\tIt<br \/>\nhas been submitted by the learned counsel for the petitioner that it<br \/>\nis a settled legal position that on registration of two offences, no<br \/>\norder of detention could have been passed, as petitioner detenu<br \/>\ncannot be branded as  bootlegger . It is further submitted that<br \/>\nthe activities of the petitioner cannot be said to be injurious to<br \/>\nthe public health or public order. It is further submitted by the<br \/>\nlearned counsel for the petitioner that there is gross delay in<br \/>\npassing the order of detention as well as there is gross delay in<br \/>\nexecuting the order of detention. The detaining authority passed the<br \/>\norder without considering the FSL report and other relevant papers.\n<\/p>\n<p>5.\tPer<br \/>\ncontra, Mr KL Pandya, learned AGP representing the respondents<br \/>\nsupported the detention order dated 4.6.2010 passed by respondent<br \/>\nNo.2   Commissioner of Police, Ahmedabad City and submitted that<br \/>\nthe detaining authority passed the order after considering all the<br \/>\nrelevant papers placed before him and therefore, the detention order<br \/>\nis legal and valid and no interference is warranted and hence, the<br \/>\npetition may be dismissed.\n<\/p>\n<p>6.\tI<br \/>\nhave gone through the grounds of detention and considered the<br \/>\narguments advanced by the learned counsel for the petitioner as well<br \/>\nas the learned AGP.\n<\/p>\n<p>7.\tThe<br \/>\nCourt is of the opinion that there is much substance in the arguments<br \/>\nadvanced by learned counsel for the petitioner. It is seen from the<br \/>\ngrounds that a general statement has been made by the detaining<br \/>\nauthority that consumption of liquor is injurious to health. In fact,<br \/>\na perusal of the order passed by the detaining authority shows that<br \/>\nthe grounds which are mentioned in the order are in reference to the<br \/>\nsituation of  law and order  and not  public order .<br \/>\nTherefore, on this ground, the subjective satisfaction of the<br \/>\ndetaining authority is vitiated on account of non-application of mind<br \/>\nand the impugned order, therefore, deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>8.\tExcept<br \/>\nthe general statement, there is no material on record which shows<br \/>\nthat the petitioner detenu is carrying on illegal activities of<br \/>\nselling liquor or is engaged in such activity, which is harmful to<br \/>\nthe health of the public. In the case of Ashokbhai Jivraj alias<br \/>\nJivabhai Solanki V\/s. Police Commissioner, Surat, reported<br \/>\nin 2001(1) GLH 393, having considered the decision of<br \/>\nthe Hon&#8217;ble Apex Court in the case of Ram Manohar Lohia v\/s. State<br \/>\nof Bihar, reported in AIR 1966 SC 740, this Court held<br \/>\nthat the cases wherein the detention orders are passed on the basis<br \/>\nof the statements of such witnesses fall under the maintenance of<br \/>\n law and order  and not  public order .\n<\/p>\n<p>9.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention, the detaining authority must come to a definite<br \/>\nfinding that there is threat to the public order. In that view of the<br \/>\nmatter, when the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>10.\tIn<br \/>\nthe result, this petition is allowed. The impugned order of detention<br \/>\ndated 4.6.2010 passed by respondent No.2 Police Commissioner,<br \/>\nAhmedabad City is hereby quashed and set aside. The detenu is ordered<br \/>\nto be set at liberty forthwith, if not required in any other case.<br \/>\nRule is made absolute accordingly.
