THE BIHAR STATE ELECTRICITY BOARD THROUGH ITS\n          CHAIRMAN VIDHYUT BHAWAN, BAILEY ROAD, PATNA-01\n          2. THE ASSISTANT ELECTRICAL ENGINEER, ELECTRIC SUPPLY\n          SUB DIVISION PESU (WEST), KHAGAUL, DISTT-PATNA\n                             -----------\n<\/pre>\n<p>02.   15.03.2011                Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the Board.\n<\/p>\n<p>                                The   petitioner   is   aggrieved        by    the    final<\/p>\n<p>                   assessment order dated 16.12.2009 fixing liability for a<\/p>\n<p>                   sum of Rs. 43,390\/- in exercise of powers under Section<\/p>\n<p>                   126 of the Electricity Act 2003 with regard to unauthorized<\/p>\n<p>                   allegedly illegal use of electricity.<\/p>\n<p>                                Learned counsel for the petitioner does not deny<\/p>\n<p>                   that he filed objections to the provisional assessment,<\/p>\n<p>                   whereafter final orders have been passed considering the<\/p>\n<p>                   objection. He however submits that the amount of theft<\/p>\n<p>                   allegedly quantified is contrary to the law and there is no<\/p>\n<p>                   allegation of excess load etc.<\/p>\n<p>                                Learned counsel for the Board submits that a<\/p>\n<p>                   First Information Report has been lodged against the<\/p>\n<p>                   petitioner     alleging   wrongful      loss     to        the    Board<\/p>\n<p>                   approximately of       Rs. 44,000\/-. The petitioner has the<\/p>\n<p>                   remedy of Appeal against the final assessment.<\/p>\n<p>                                Learned counsel for the petitioner submits that<\/p>\n<p>                   he has been granted installment for payment and that he<\/p>\n<p>                   has paid 9 installments already. Though, there is no such<\/p>\n<p>                   statement on record.\n<\/p>\n<p><span class=\"hidden_text\">                         2<\/span><\/p>\n<p>               If the petitioner prefers an Appeal against the<\/p>\n<p>      final assessment before the appropriate authority and<\/p>\n<p>      satisfies it that he has already paid 50% of the dues, the<\/p>\n<p>      Court expects that appropriate authority shall consider his<\/p>\n<p>      Appeal without insisting upon the statutory deposit for<\/p>\n<p>      50% of the amount as a pre-condition.\n<\/p>\n<p>               The Court expects that the Appeal shall be<\/p>\n<p>      disposed off expeditiously without unnecessary delay<\/p>\n<p>      provided the petitioner himself co-operates.<\/p>\n<p>               The application stands disposed.\n<\/p>\n<\/p>\n<pre>P.K                                   (Navin Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anju Bala Sinha vs The Bihar State Electricity Bo on 15 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.698 of 2010 1.
