Rule discharged qua applicants Nos. 1 and 2.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant submits that the<br \/>\ninvestigation is over and charge sheet is filed and looking to the<br \/>\npapers of charge sheet the story of having seen the incident by one<br \/>\nwitness namely Sundabhai is absolutely unbelievable and this witness<br \/>\nis got up one as an eye witness to the incident after wards.  It is<br \/>\nsubmitted that the complainant is not an eye witness.  It is<br \/>\nsubmitted that the<br \/>\nentire case of the prosecution revolves round the statements of two<br \/>\nwitnesses viz. Sundabhai and Sadabhai Thakore, who have changed their<br \/>\nversion about number of persons assaulted the deceased and the<br \/>\nweapons used by them.  The statement of Sundhabhai is recorded after<br \/>\n20 days  and the complainant is<br \/>\nnot an eye witness.  So far as Sadabhai is concerned, the statements<br \/>\nrecorded on 09.01.2011 and 13.01.2011 and affidavit filed in the<br \/>\noffice of the lawyer on 24.01.2011 have different versions.  So is<br \/>\nthe case with Sundabhai, who claims to be an eye witness of the<br \/>\nincident, who has also sworn the affidavit in the office of an<br \/>\nadvocate and again changed his version about number of persons<br \/>\npresent at the scene of offence and played overt act. In view of the<br \/>\nabove, it is submitted that the version of the above eye witnesses is<br \/>\nnot trust worthy and when trial is likely to prolong, keeping the<br \/>\napplicant behind the bars is not advisable.  In addition to the<br \/>\nabove, it is submitted that the report of the FSL is sent in the<br \/>\ncontext of section 27 discovery panchnama in the context of seizure<br \/>\nof recovery of the weapons though it may be subject to the evidence<br \/>\nbefore the trial court, but at this stage, the benefit be given to<br \/>\nthe applicant, who is at the most attributed with usage of hockey<br \/>\nstick.\n<\/p>\n<p>\tPer<br \/>\ncontra, learned APP as well as learned Senior Advocate for the<br \/>\ncomplainant have vehemently opposed the grant of bail on the ground<br \/>\nthat veracity or the trustworthy of the witnesses cannot be gone into<br \/>\nand same would be subject matter of trial and no benefit of doubt be<br \/>\ngiven to the applicant in exercise of powers under section 439 of the<br \/>\nCode.  It is further submitted that if the postmortem report is<br \/>\nperused injuries would reveal that CLW and a thick swollen reddish<br \/>\nwound on the parietal region coupled with the cause of death  is due<br \/>\nto injuries on the vital part of the body in a heinous crime<br \/>\npunishable under section 302 of the IPC, the accused is not entitled<br \/>\nfor bail.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase, including statements, prima facie it appears different versions<br \/>\nabout number of persons assaulted and the weapons used, besides<br \/>\nnature of injuries, recovery panchnama and FSL report, I am of the<br \/>\nopinion that involvement of the applicant at this stage, in<br \/>\ncommission of the crime is based on version of the witnesses whose<br \/>\nstatements have been recorded from time to time which appeared to be<br \/>\nfull of contradictions and, therefore, at this stage, I am inclined<br \/>\nto enlarge applicant No.3 on bail in connection with C.R.No.I-4\/2011<br \/>\nof Bhabhar Police Station  for the offences punishable under sections<br \/>\n302, 323, 201 &amp; 34 of the Indian Penal Code, on furnishing bond<br \/>\nof Rs.10,000\/- (Rupees ten thousand only) with one surety of the like<br \/>\namount to the satisfaction of the lower Court and on conditions that<br \/>\nthe applicant No. 3 shall :\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p>[e]\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe address of residence at the time of execution of the \tbond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately;\n<\/p>\n<p>[h]\tshall<br \/>\nnot enter into the district and city limits of  Banaskantha district<br \/>\nfor a period of 3 months except for marking presence and attending<br \/>\ntrial.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial court shall not be influenced by the prima facie<br \/>\nobservations made by this Court while enlarging the applicant on<br \/>\nbail.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
