It<br \/>\nis also made out that two posts are vacant on which the petitioners<br \/>\ncan be appointed but, their appointment against the vacant posts is<br \/>\nnot for 10 years, which is the requirement of the State Government&#8217;s<br \/>\nCircular.  As and when the petitioners fulfill that requirement, the<br \/>\nState Government will consider their cases for being regularised.  In<br \/>\nthe meanwhile, no appointments should be made against those vacancies<br \/>\nbecause, the petitioners will be given first claim on those two<br \/>\nvacant posts.\n<\/p>\n<p>2.\t\tBy<br \/>\norder dated 10.05.2010 in civil application, ad-interim relief was<br \/>\ngranted to stay execution of the impugned judgment and order. It is<br \/>\nstated at the bar by learned A.G.P. that, subsequent to admission of<br \/>\nthe appeal and grant of ad-interim relief, the petitioners have<br \/>\npartly succeeded in another petition, being SCA No.2742 of 2009,<br \/>\nwherein order dated 16.06.2009 is made by this Court (Coram:<br \/>\nM.R.Shah, J.) in the following terms:\n<\/p>\n<p> It<br \/>\nis reported that the respective petitioners as on today are<br \/>\nreinstated by the concerned hospital\/trust. Under the circumstances,<br \/>\nno further order is required to be passed except observing that the<br \/>\nrespective petitioners be continued  as part-timer sweeper\/peon on<br \/>\nthe same terms and conditions on the day their services came to be<br \/>\nterminated. With these present<br \/>\nSpecial Civil Application  is disposed of.\n<\/p>\n<p>3.\t\tNo<br \/>\none is present for respondents, though served. It is clear and fairly<br \/>\nconceded that upon reinstatement of  original petitioners, the<br \/>\nquestion of filling up the posts in the meantime did not arise, and<br \/>\nthe respondents herein have continued to be employed by the<br \/>\nappellant.  Therefore, the only contention of learned A.G.P. was that<br \/>\nthe respondents having been irregularly appointed on part-time basis,<br \/>\ntheir services could not be regularized even after continuous service<br \/>\nof ten years in terms of Government Resolution dated 01.05.2007 and,<br \/>\ntherefore, the direction to consider their case for regularization<br \/>\nwas required to be set aside.\n<\/p>\n<p>4.\t\tThe<br \/>\nresolution dated 01.05.2007 relied upon for the appellant is<br \/>\nexpressly based upon the judgment of the Supreme Court and this<br \/>\nCourt. This Court has, in <a href=\"\/doc\/233201\/\">Jadav<br \/>\nNikeshkumar Mafatlal v. State of Gujarat<\/a> [2007 (1) G.L.H.88],<br \/>\nmade the following pertinent observations, and that judgment is<br \/>\nadmittedly accepted by the Government and the aforesaid resolution<br \/>\nclearly appears to have been based on those observations:\n<\/p>\n<p> 17.1\t\t&#8230;&#8230;&#8230;\n<\/p>\n<p>Since<br \/>\nmany of the petitioners employed for more than ten years and for six<br \/>\nhours or more per day are stated to have worked against sanctioned<br \/>\nposts, the respondents are required to consider such cases on the<br \/>\nbasis of the facts and circumstances of each case. It may be<br \/>\npertinent to add and observe that the State Government, while<br \/>\nprescribing the minimum rates of wages in scheduled employment under<br \/>\nthe Minimum Wages Act, 1948, usually provide for payment of full<br \/>\nwages in case the hours of work exceed<br \/>\nfive hours per day. Therefore, ideally, a part-time employee working<br \/>\nfor six or more hours per day since more than<br \/>\nten years should be considered as a full-time employee for the<br \/>\nbenefit of regularization, if he is otherwise eligible and covered by<br \/>\nthe exceptional clause and directions contained in paragraph 53, as<br \/>\nmentioned hereinabove.  Age-bar cannot, in the nature of things, be<br \/>\ninvoked in consideration of such cases and for effectuating the<br \/>\nmandate. Since the averments in particular petitions of the<br \/>\npetitioner actually working full time, though treated and branded as<br \/>\na part-timer, are neither substantiated nor specifically traversed,<br \/>\nthe respondents have to be left to consider such cases in light of<br \/>\nactual facts and the above direction of the Hon&#8217;ble Apex Court [in<br \/>\nSecretary,<br \/>\nState of Karnataka v. Uma Devi  (2006) 4 SCC 1].\n<\/p>\n<p> 18.\t\tProtection<br \/>\nor injunction against termination of service is denied with the<br \/>\nclarification that it should not be understood to mean that all the<br \/>\npetitioners whose services are required and who are presently in<br \/>\nservice, with or without an interim injunction of the court, have to<br \/>\nbe necessarily discharged by the respondents. Since raison d&#8217;etre and<br \/>\njustification for the apprehension of huge future liabilities in<br \/>\nrespect of such employees are removed by the Constitution Bench<br \/>\njudgment of the Supreme Court in <a href=\"\/doc\/1591733\/\">Secretary,<br \/>\nState of Karnataka v. Umadevi<\/a> (supra),<br \/>\nthe respondents may as well consider the issue of redefining the term<br \/>\nand conditions of such contracts of service on a just and reasonable<br \/>\nbasis.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute only to the aforesaid extent, with no order as to<br \/>\ncosts.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe peculiar facts of the present case, setting aside the direction<br \/>\nto even consider the case of the respondents for regularization would<br \/>\nmean and amount to the respondents being permanently condemned to the<br \/>\nstatus of  part-time<br \/>\nsweepers\/peons on the same term and conditions<br \/>\n in terms of the latter order dated 16.6.2009 in SCA No.2742 of 2009.<br \/>\nIf the appellant do not propose to subject the respondents to such<br \/>\ntreatment, the only course open for the appellant would be to<br \/>\nterminate their service in accordance with law. Therefore, although<br \/>\nit is not obligatory upon the appellant to regularize service of the<br \/>\nrespondents and it is not permissible for this Court to direct<br \/>\nregularization of their service in the face of Constitution Bench<br \/>\ndecision of the Supreme Court in Secretary,<br \/>\nState of Karnataka v. Uma Devi<br \/>\n(supra), it has to be left  to the discretion  and good conscience<br \/>\nof the appellant to make appropriate order in respect of service<br \/>\nconditions of the respondents, for which the direction to consider<br \/>\ntheir case must be preserved.  As observed in  <a href=\"\/doc\/233201\/\">Jadav<br \/>\nNikeshkumar Mafatlal v. State of Gujarat<\/a> (supra),<br \/>\nabsence<br \/>\nof protection or injunction against termination of service should not<br \/>\nnecessarily mean that the employees whose services are required and<br \/>\nwho are presently in service have to be necessarily discharged.  It<br \/>\nis also suggested in that judgment that the Government may as well<br \/>\nconsider the issue of redefining the term and conditions  of such<br \/>\ncontract of service on a just and reasonable basis.\n<\/p>\n<p>6.\t\tTherefore,<br \/>\nin the facts and for the reasons discussed hereinabove, the appeal is<br \/>\npartly allowed so as to modify the impugned order to the extent that<br \/>\nthe State Government will be at liberty to consider cases of the<br \/>\nrespondents for redefining the conditions of their service, but the<br \/>\nrespondents shall have no superior claim to permanent employment only<br \/>\non the basis that they have completed ten years of service on<br \/>\ntemporary and part-time basis against vacant posts. It may not be<br \/>\nout of place to mention the constitutional goal of securing economic<br \/>\nand social justice and the directive principles of state policy<br \/>\nenshrined in the Preamble, and Article 43 in particular, in the<br \/>\nConstitution. With these observations, the appeal is partly allowed<br \/>\nwith no order as to costs.
