Justice K.HEMA\n\n Dated :15\/10\/2008\n\n O R D E R\n                             K.HEMA, J.\n                -------------------------------------------------\n                         B.A.No.6288 of 2008\n                -------------------------------------------------\n             Dated this the 15th day of October, 2008\n\n\n                                O R D E R\n<\/pre>\n<p>     This petition is for bail.\n<\/p>\n<p>     2.   The alleged offences are under Sections 55(g) and<\/p>\n<p>8(2) of Abkari Act. According to prosecution, petitioner was<\/p>\n<p>found in possession of 400 litres of wash, which was kept for<\/p>\n<p>manufacturing illicit arrack.           Five litres of arrack was also<\/p>\n<p>seized. Petitioner was arrested only on 16.9.2008 since he ran<\/p>\n<p>away. Petitioner is in custody for the past 29 days.<\/p>\n<p>     3.   Learned public prosecutor submitted that he has no<\/p>\n<p>objection in granting bail to the petitioner, but, stringent<\/p>\n<p>conditions may be imposed.\n<\/p>\n<p>     Hence, bail is granted to the petitioner on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<blockquote><p>     (i)  Petitioner shall execute a bond for Rs.25,000\/- with<\/p>\n<p>          two solvent sureties each for the like sum to the<\/p>\n<p>          satisfaction of the Magistrate Court concerned.<\/p>\n<\/blockquote>\n<blockquote><p>    (ii)  Petitioner shall report before the Investigating Officer<\/p>\n<p>          on every alternate day between 10 a.m. and 1 p.m.<\/p>\n<p>          until further orders.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">BA No.6288\/08                   2<\/span><\/p>\n<\/blockquote>\n<p>   (iii)   Petitioner shall not commit any offence while on bail<\/p>\n<p>           and in case of breach of this condition, bail is liable to<\/p>\n<p>           be cancelled.\n<\/p>\n<p>\n    The petition is allowed.\n<\/p>\n<\/p>\n<p>                                               K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vinodan vs State Of Kerala Through The Excise on 15 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6288 of 2008() 1.
