NAOLEKAR\n\nJUDGMENT:\n<\/pre>\n<p>JUDGEMENT<\/p>\n<p>P.P.NAOLEKAR, J.\n<\/p>\n<p>\t\tThree accused persons viz., Seeman, Neelagiri and<br \/>\nLeelavathi, were tried for committing murder of one Murugan,<br \/>\nunder Section 302 IPC.  Accused  appellant no.1 was convicted<br \/>\nand sentenced to undergo life imprisonment by the Sessions<br \/>\nCourt.  The other two accused persons were acquitted.  The said<br \/>\nconviction and sentence, having been confirmed by the High<br \/>\nCourt, the appellant challenged the same before this Court by<br \/>\nfiling this appeal. The prosecution case, in short is that the<br \/>\ndeceased Murugan was the resident of Village Chithakkur.<br \/>\nThree years prior to the occurrence, deceased Murugan and a girl<br \/>\nnamed Kani fell in love and eloped from the Village.  They were<br \/>\nbrought back by the villagers.  After some time, Kani was<br \/>\nmarried to some other person and deceased Murugan also got<br \/>\nmarried to some other girl of a nearby village.  On account of<br \/>\nthis incident,  the accused persons had grudge to grind against<br \/>\nthe deceased, having brought bad name to the family and were<br \/>\nawaiting an opportunity to take revenge.  The deceased was<br \/>\nadvised by the well-wishers to leave the Village and settle down<br \/>\nat some other place.  He settled at Village Kariappati.  On the<br \/>\nday of the incidence, i.e., 26.1.92 deceased came to Chithakkur<br \/>\nin search of his grandmother.  At the Village, he was informed<br \/>\nthat his grandmother has left the Village and has gone to a place<br \/>\nThirukkani to collect her pension.  The information was given to<br \/>\nhim by PW2  Raja @ Perumal.  Thereafter, the deceased along<br \/>\nwith Raja @ Perumal proceeded towards the bus stand so that<br \/>\nthe deceased could catch a bus.  At the bus stop when the<br \/>\ndeceased along with PW-2 were awaiting for a bus, they  saw<br \/>\naccused no.2 at the bus stop who stared at the deceased.<br \/>\nApprehending that some untoward incident  may happen, he was<br \/>\nadvised to go to the residence of PW-1-Danam @<br \/>\nBalasubramanian.  In the meanwhile the bus came and stopped at<br \/>\nsome distance from the place where they were standing and the<br \/>\ndeceased rushed towards the bus.  At that time accused no.3<br \/>\nholding broom in her hand accosted the deceased as to why he<br \/>\nwas running and asked him to stop.  Suddenly, accused no.1<br \/>\nappeared at the bus stop and attacked the deceased with patta<br \/>\nknife and inflicted number of injuries.  The deceased fell down<br \/>\non the spot and succumbed to his injuries.  PW1 lodged the FIR<br \/>\nimmediately after the incident claiming that he himself, one<br \/>\nJayaraj and Raja witnessed the incident.  The postmortem on the<br \/>\ndead body was conducted by PW-7 &#8211; Dr. Edwin Joe who found<br \/>\nthe following injuries on the person of the deceased.\n<\/p>\n<p>1.\tTransverse cut injury and sides of neck<br \/>\n21 cms. Length x 5 cms. X 9 cms., the right end<br \/>\nis 8 cms. Below and front of right ear, the left<br \/>\nend is 7 cms. below and back of the left ear and<br \/>\n0.5 cm. below chin.  The wound is found to have<br \/>\ncut the underlying muscles, wind pipe between<br \/>\nthyroid and hyoid bone, food pipe, the left<br \/>\ncarotid artery and jugular veins on both sides<br \/>\nand cutting the 4th cervical vertebrae 4 x 0.5 x 2<br \/>\ncms. and the underlying cord partially.  The<br \/>\nedges are clear cut.\n<\/p>\n<p>2.\tAn oblique skin deep incised wound 6<br \/>\ncms. length lateral aspect of middle of right arm.\n<\/p>\n<p>3.\tA vertically oblique cut wound left<br \/>\nfronto-parietal region 5 x 1 cm. cutting the<br \/>\nunderlying bone 10 cms. above left earlobe.\n<\/p>\n<p>4.\tA flapping cut injury 4 x 3 x 2 cms.\n<\/p>\n<p>(muscle deep) on the right posterior occipital<br \/>\nregion with a skin flap hanging downwards 3<br \/>\ncms. lateral to the midline.\n<\/p>\n<p>5.\tScratch abrasion 3 cms. length top of<br \/>\nright shoulder.\n<\/p>\n<p>6.\tAbrasion 1 x 0.5 cm. and 0.5 x 0.5 cm.\n<\/p>\n<p>inferior angle of right scapula.\n<\/p>\n<p>The Sessions Court convicted Appellant No.1 relying on<br \/>\nthe statement of PW1 and PW2 and drew corroboration to their<br \/>\ntestimony from medical evidence.  The other two accused were<br \/>\nacquitted giving benefit of doubt.  The High Court has only<br \/>\nrelied upon the statement of PW2 as an eye-witness and found<br \/>\ncorroboration to his statement from the medical evidence.  The<br \/>\nevidence of PW1 was relied upon only for the purposes of<br \/>\nsetting the law into motion by lodging an FIR.<br \/>\nThe learned counsel for the appellant has challenged the<br \/>\nconviction of A-1 contending that:\n<\/p>\n<p>(i) the statement of PW1 being the sole eye-witness, cannot be<br \/>\nrelied upon for convicting the accused, particularly when he is<br \/>\nthe close relative of the deceased and when the independent<br \/>\nevidence was available with the prosecution; (ii)  the presence of<br \/>\nPW2 at the place of incident itself is doubtful.  In fact it was the<br \/>\nbrother of PW2, Raja who was named as an eye-witness in the<br \/>\nFIR and not PW-2 Raja @ Perumal. Apart from this PW2&#8217;s<br \/>\nstatement in regard to other acquitted accused having been<br \/>\ndiscarded by the Court, the statement, as regards the  accused<br \/>\nappellant,  does not inspire confidence and (iii) it is further urged<br \/>\nthat the statement of PW-2 is not fully supported by medical<br \/>\nevidence.  The injury which has been attributed to have been<br \/>\ncaused by the appellant on the back of the deceased, was not<br \/>\nfound in the postmortem report.  All these infirmities<br \/>\nindividually and cumulatively create a doubt as to whether PW1<br \/>\nwas at all an eye-witness as claimed by the prosecution and the<br \/>\nconviction cannot be based on the testimony of  sole witness.<br \/>\n\t\tIt is now well settled that the evidence of witness cannot<br \/>\nbe discarded merely on the ground that he is a related witness or<br \/>\nthe sole witness, or both, if otherwise the same is found credible.<br \/>\nThe witness could be a relative but that does not mean to reject<br \/>\nhis statement in totality.  In such a case, it is the paramount duty<br \/>\nof the court to be more careful in the matter of scrutiny of<br \/>\nevidence of the interested witness, and if, on such scrutiny it is<br \/>\nfound that the evidence on record of such interested sole witness<br \/>\nis worth credence, the same would not be discarded merely on<br \/>\nthe ground that the witness is an interested witness.    Caution is<br \/>\nto be applied by the court while scrutinizing the evidence of the<br \/>\ninterested  sole witness.  The prosecution&#8217;s non-production of<br \/>\none independent witness who has been named in the FIR by<br \/>\nitself cannot be taken to be a circumstance to discredit the<br \/>\nevidence of the interested witness and disbelieve the prosecution<br \/>\ncase.  It is well settled that it is the quality of the evidence and<br \/>\nnot the quantity of the evidence which is required to be judged<br \/>\nby the court to place credence on the statement.<br \/>\n\t\tThe FIR was lodged by PW-1 in the present case who<br \/>\nwas not found to be an eye-witness by the High Court.<br \/>\nAdmittedly, FIR does not name Raja @ Perumal as an eye-<br \/>\nwitness.  The FIR contains the name of Raja as an eye-witness.<br \/>\nIt has also come in evidence that the name of the elder brother of<br \/>\nPW2 is also Raja and on this basis it is urged that it is this Raja<br \/>\nwho is the elder brother of PW-2, that has witnessed the<br \/>\noccurrence but he was not examined by the prosecution.<br \/>\nTherefore, the statement of PW-2 could not have been relied<br \/>\nupon by the Court.  From the evidence of Investigating Officer it<br \/>\nreveals that immediately after the incident, I.O. reached the spot<br \/>\nand prepared the inquest report  Exb.P13.  The name of Raja @<br \/>\nPerumal is written in column no.3 as a witness which shows  that<br \/>\nimmediately after the incident Raja @ Perumal has been referred<br \/>\nas an eye-witness.  During the course of investigation, the police<br \/>\nalso recorded  the statement of Raja @ Perumal and not that of<br \/>\nRaja who is the elder brother of PW-2.  Upon careful reading of<br \/>\nthe statement of PW-2 it appears to us that he was present at the<br \/>\nspot when the incident took place.  It has come in his evidence<br \/>\nthat he has accompanied Murugan, the deceased from his place<br \/>\nto the bus stop whereas the elder brother has left the house for<br \/>\nhis tuitions.  We have no manner of doubt that it is PW-2 who<br \/>\nhas witnessed the occurrence.  Accused nos. 2 and 3 were<br \/>\nacquitted not because the statement of PW-2 was not relied upon<br \/>\nbut they were given benefit of doubt as their alleged acts were<br \/>\nnot mentioned in the FIR by PW-1.  Apart from this, PW-2&#8217;s<br \/>\nstatement that A-2 came to the bus stop and stared at the<br \/>\ndeceased and A-3 holding broom in her hand questioned him as<br \/>\nto why he was running and asked him to stop when he was<br \/>\nrushing towards the bus in no manner implicate those accused<br \/>\npersons in commission of crime.   The statement even if relied<br \/>\nupon does not indicate that they instigated the accused-appellant<br \/>\nto attack the deceased or to commit a crime. In the circumstance,<br \/>\ndiscarding that portion of the evidence does not in any manner<br \/>\naffect the veracity of the  evidence of this witness as regards the<br \/>\naccused  appellant.\n<\/p>\n<p>\t\tPW-2 while describing the incident, has deposed that A-<br \/>\n1-appellant Seeman had inflicted injury on the neck of the<br \/>\ndeceased by patta knife and, thereafter caused cut on the right<br \/>\nside of his head and further inflicted cut on the neck and that he<br \/>\nhas also inflicted injuries on the back.  It is submitted by the<br \/>\nlearned counsel that no injury was found on the back of the<br \/>\ndeceased and, therefore, the medical evidence does not<br \/>\ncorroborate the statement of PW-2.  It is to be noticed that the<br \/>\nduration of the occurrence was short.  The injuries on the<br \/>\ndeceased were inflicted with quick succession and it is too much<br \/>\nto expect from a witness in such circumstance to narrate the<br \/>\nexact injuries caused on a person of the deceased.  The<br \/>\ngenaralised statement as regards the injuries would be more<br \/>\ncredible than the particularized statement of location of injuries<br \/>\non the body when the injuries were caused in quick succession<br \/>\nand in short time.  Moreover, there is every possibility of the<br \/>\nfirst injury being caused from the back side of the deceased.  On<br \/>\nscrutiny of the evidence of PW-2 and the medical evidence we<br \/>\nare of the opinion that medical evidence corroborates the<br \/>\nstatement of eye-witness, PW-2.  Both, the sessions court and the<br \/>\nHigh Court, after scrutiny of the evidence of PW-2 has relied<br \/>\nupon the statement and we do not find discernible discrepancy in<br \/>\nthe evidence of PW-2 not to place reliance on his evidence.
