Advocate  appears and states that he has received<br \/>\ninstructions to \tappear for respondent no. 3 -District Primary<br \/>\nEducation Officer, Ahmedabad. He shall enter his appearance<br \/>\nrepresenting him latest by tomorrow.\n<\/p>\n<p>2.\t\tMr.\n<\/p>\n<p>LB Dabhi, Ld. AGP for respondents nos. 1 and 2 &#8211; State of<br \/>\nGujarat as well as Panchayat, Rural Housing and Rural Development<br \/>\nDepartment, Sachivalaya, Gandhinagar, states that the Deputy<br \/>\nSecretary, \tPanchayat, Rural Housing and Rural Development<br \/>\nDepartment, Sachivalaya, Gandhinagar,  has passed the order dated<br \/>\n12\/10\/2010 directing District Development Officer, Ahmedabad to give<br \/>\ncompassionate appointment to the petitioner on the post of Class-III<br \/>\nin fixed salary of Rs.4,500\/- p.m., on ad-hoc basis on the terms and<br \/>\nconditions mentioned therein.  Therefore, according to him, the<br \/>\npetition filed for alleged contempt committed by the respondent, now<br \/>\nassume no survival value. He, therefore, urges to pass appropriate<br \/>\norder. He has also placed on record copy of the order dated<br \/>\n12\/10\/2010 passed by the Deputy Secretary, Panchayat, Rural Housing<br \/>\nand Rural Development Department, Sachivalaya, Gandhinagar, for<br \/>\nperusal of this Court.\n<\/p>\n<p>3.\t\tMs.\n<\/p>\n<p>Tejal Shah, Ld. Advocate for the petitioner states that since the<br \/>\norder directing the District Development Officer, Ahmedabad, to give<br \/>\ncompassionate appointment to the petitioner has been passed on<br \/>\n12\/10\/2010, she has not been informed about the said order by her<br \/>\nclient, as the said order is not communicated to her client.  She,<br \/>\ntherefore, prays to adjourn the matter to enable her to take<br \/>\ninstructions from her client as to whether the District Development<br \/>\nOfficer has passed the order giving compassionate appointment to the<br \/>\npetitioner pursuant to the order passed by the Deputy Secretary,<br \/>\nPanchayat, Rural Housing and Rural Development Department, on the<br \/>\nterms and conditions mentioned therein or not.\n<\/p>\n<p>4.\t\tHence,<br \/>\nby consent matter is adjourned to  15\/10\/2010.\n<\/p>\n<p>5.\t\tCopy<br \/>\nof the said order dated 12\/10\/2010 shall be retained on the record of<br \/>\nthe case.\n<\/p>\n<p>(A.M.\n<\/p>\n<p>Kapadia, J.)<\/p>\n<p>(<br \/>\nJ.C.
