M. SAHAI)<\/a><\/p>\n<p>1\tWe<br \/>\nhave heard Mr.Mihir Joshi, learned Senior Counsel   assisted by Mr.<br \/>\nDipen A Desai, learned Advocate, for the petitioner and Mr. Prakash<br \/>\nJani, learned Government Pleader assisted by Mr. N.J.Shah and<br \/>\nMs.Jirga Jhaveri, learned Assistant Government Pleaders, for the<br \/>\nrespondents. Learned Counsel appearing for the parties have agreed<br \/>\nthat instead of deciding the writ petitions on merits,<br \/>\nthis Court may direct that the respondents to hold  elections of the<br \/>\nAgricultural Produce Market Committee, Kalavad, District-Jamnagar, at<br \/>\nthe earliest.\n<\/p>\n<p>2\tWe,<br \/>\ntherefore, without entering into the merits of the case,  direct the<br \/>\nrespondents to hold the elections of the Agricultural  Produce Market<br \/>\nCommittee, Kalavad, District- Jamnagar, within a period of  three<br \/>\nmonths from today. The interest of justice also demands to direct the<br \/>\nAdministrator appointed by the State Government that the<br \/>\nAdministrator shall not enroll any new member nor shall send any<br \/>\ninformation to the authorities against any member and, if, he sends<br \/>\nany information, the same shall not be acted upon.\n<\/p>\n<p>3\tMr.\n<\/p>\n<p>Jani, learned Government Pleader, has produced  before us  a fax<br \/>\nmessage wherein the instructions are issued by the State Government<br \/>\nthat the respondents will hold the elections of Agricultural Produce<br \/>\nMarket Committee, Kalavad, District &#8211; Jamnagar    within a<br \/>\nperiod of six months. The said fax message is ordered to be taken on<br \/>\nrecord of the writ petition. However, we are not inclined to accept<br \/>\nthe said request of the State Government as the election should be<br \/>\nheld by the State Government or the respondents  within a period of<br \/>\nthree months.\n<\/p>\n<p>4\tWith<br \/>\nthe aforesaid directions, the petition stands disposed of<br \/>\naccordingly.\n<\/p>\n<p>5\tIn<br \/>\nview of the aforesaid order, Special Civil Application No. 9019 of<br \/>\n2011 also stands disposed of accordingly.
