Narayana, J.<\/p>\n<p>1. Heard Sri D.V. Sitaram Murthy, Counsel representing the Revision Petitioner and Sri I.R. Joshi, Counsel representing Sri Vijay Sen Reddy, Counsel representing the respondent.\n<\/p>\n<p>2. This Revision is preferred as against an order made in E.A. No. 65\/2002 in O.E.P. No. 26\/2001 in A.T. No. 10\/2000-01 made by the Senior Civil Judge, Puttur on 2-7-2003. The said E.A. No. 65\/2002 was filed on the ground that the Senior Civil Judge, Puttur, has no jurisdiction to entertain the E.P. at all. As I can see from the impugned order, several other aspects also had been discussed and when once the question of jurisdiction of the Court to entertain the E.P. is decided, I am of the considered view that the other questions which had been discussed in the impugned order would fall into total insignificance.\n<\/p>\n<p>3. Sri D.V. Sitaram Murthy, the learned Counsel representing the Revision Petitioner had drawn the attention of this Court to Section 2(1)(e) of the Arbitration and Conciliation Act, 1996, hereinafter in short referred to as &#8220;Act&#8221; and had contended that Court means the principal Civil Court of original jurisdiction in a District and at any stretch of imagination, it cannot be said that the Senior Civil Judge, Puttur is the principal Court of original jurisdiction of the District and hence the E.P. should not have been entertained by the said Court. The learned counsel placed strong reliance on Ankati Satyamaiah v. Sallangula Lalaiah, 2003 (1) ALT 193 in this regard.\n<\/p>\n<p>4. Per contra, Sri I.R. Joshi, the learned counsel representing the respondent submitted that the merits and demerits relating to the, award made also had been discussed in the impugned order apart form the question of executability by the learned Senior Civil Judge at Puttur. The counsel also submitted that the conditional order made by this Court also had not been complied with and the Revision Petitioner is driving the respondent from pillar to post and it would be very difficult if the interest of the respondent is not safeguarded in the meanwhile. The learned counsel also contended that in view of the pecuniary limitations which differ from one State to another, on advice, the respondent had filed the E.P. before the Senior Civil Judge, Puttur and in such circumstances, there is no legal bar to order transfer of the said E.P. to the file of the District Court, Chittoor, which is the principal Court of original jurisdiction of the District instead of allowing the C.R.P., the consequence of which would be dismissal of the E.P. The learned counsel also submitted that even otherwise, in the meanwhile, at least the interest of the respondent may be protected, if not the respondent will not be able to realize any amount.\n<\/p>\n<p>5. Heard both the counsel. On a careful perusal of the impugned order, not only the question of jurisdiction of the Court to entertain the E.P., but certain other questions also had been decided which may not be germane for the present purpose. The question in controversy now to be decided is whether the Senior Civil Judge, Puttur is empowered under law to entertain the E.P. or not.\n<\/p>\n<p>6. Section 2 of the Act deals with Definitions and Section 2(1)(e) defines &#8220;Court&#8221; as:\n<\/p>\n<p> &#8220;In this part, unless the context otherwise requires, &#8220;Court&#8221; means the Principal Civil Court of original jurisdiction in a District and includes the High Court in exercise of its ordinary civil jurisdiction, having jurisdiction to decide the questions forming the subject matter of the arbitration if the same had been the subject matter of a suit, but does not include any Civil Court of a grade inferior to such principal Civil Court or any Court of Small Causes&#8221;.\n<\/p>\n<p>There cannot be any doubt or controversy that definitely the Senior Civil Judge, Puttur is not the principal Court of original jurisdiction of the District within the meaning of Section 2(1)(e) of the Act. In the decision referred supra, while dealing with a similar question, this Court held at para 12:\n<\/p>\n<p> &#8220;A plain reading of Section 3, Clause (17) of the General Clauses Act shows that the Principal Civil Court of original jurisdiction means the District Court inasmuch as the district Judge is the Presiding Officer of that Court. Both the provisions (Section 3(17) of General Clauses Act and Section 2(4) of CPC) make it manifest that a District Court in a district is the principal Civil Court of original jurisdiction. When the Court considers the expression &#8220;the Principal Civil Court of original jurisdiction in district&#8221; appearing in the first part of Clause (e) of Section 2 of the Act the definition of the word &#8220;Court&#8221; in conjunction with the meaning given in Section 2, Clause (4)( of the C.P.C. and Clause (17) of Section 3 of the General Clauses Act, it is obvious that it is the Court of District Judge, that is, the Principal Civil Court of original jurisdiction in a District. Not only that, the definition as given under Section 2(e) expressly excludes any other Civil Court of a grade inferior to such Principal Civil Court or any Court of Small Causes. Therefore, the last limb of Section 2(e) is more emphatic that it shall be only the Principal Civil Court of original jurisdiction in a district and no other Court. This, therefore, leaves no room for any doubt that the expression &#8220;Court&#8221; as envisaged under Section 2(e) means only the &#8220;Principal Civil Court of original jurisdiction&#8221; in a district which is obviously the District Court. There is no reason to construe the expression &#8220;the Principal Civil Court of original jurisdiction&#8221; in a district which is obviously the District Court. There is no reason to construe the expression &#8220;the Principal Civil Court of original jurisdiction&#8221; as envisaged under Section 2(e) of the act in a different sense than what has been envisaged by the two provisions under the code of Civil procedure and the General Clauses Act referred to hereinabove.\n<\/p>\n<p>It was further held at para 13:\n<\/p>\n<p> &#8220;Here is a case where, according to the facts, the parties are residents of Miryalaguda, Hyderabad and Nalgonda, respectively. They referred the matter to the Arbitrators who are the residents of Hyderabad. It is not known whereat the arbitral agreement was entered into between the parties inter se. However, the Arbitrators ultimately after due deliberations passed the award on 18-9-2001 at Hyderabad. Having regard to the nature of the dispute between the parties, which pertains to execution of a contract work, when court looks at the provisions of the C.P.C., the residuary provision of Section 20 is applicable for deciding the question of jurisdiction of the Court. Having regard to the above criterion, the jurisdiction is either with the Court at Miryalaguda or the Courts at Hyderabad. Therefore, either of the parties, if need be, can approach the Courts at Hyderabad or at Miryalaguda in Nalgonda District, or at Nalgonda having due regard to the residence of the parties and the cause of action that has arisen either in whole or in part. If a suit were to be filed, the suit shall have to be instituted before one of the Courts either at Nalgonda or at Miryalaguda or at Hyderabad. That Court, which has jurisdiction to entertain the suit between the parties, shall be the Principal Civil Court of original jurisdiction in a district and it shall not be inferior to such Principal Civil Court or any Court of Small Causes. Therefore the suit shall have to be filed before the principal Civil Court of original jurisdiction either at Nalgonda, or at Hyderabad, Obviously the same court can enforce the award as if it were a decree passed by that Court having regard to Section 36 of the Act.&#8221;\n<\/p>\n<p>In view of the same, I have no hesitation in holding that the entertainment of the E.P. by the Senior Civil Judge, at Puttur is without authority and jurisdiction. It is needless to say that the District Court, at Chittoor would be the principal Court of original jurisdiction of the District. No doubt, the Counsel representing the respondent had prayed to issue a direction to transfer the said O.E.P. No. 26\/2001 on the file of Senior Civil Judge, Puttur to the District Court, Chittoor. In the facts and circumstances of the case, I do not think that it would be just and proper to issue such a direction. In view of the same, the impugned order is hereby set aside holding that the Senior Civil Judge, Puttur is not the principal Court of original jurisdiction of the District within the meaning of Section 2(1)(e) of the Act and consequently, liberty is given to the respondent to invoke the jurisdiction of the proper Court aforesaid forthwith. In view of the request made by the learned Counsel representing the respondent to safeguard the interest of the respondent, the learned District Judge, Chittoor, if an execution in this regard is moved, shall entertain the same forthwith and pass appropriate orders depending upon the facts and circumstances of the case. Except giving this direction, no other relief can be granted by this Court.\n<\/p>\n<p>7. The Civil Revision Petition is accordingly allowed.
