Heard learned counsel for the petitioner and learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                  It is alleged that after execution of agreement and<\/p>\n<p>                     receiving some amount in advance for sale of land, the petitioner<\/p>\n<p>                     refused to execute the sale deed. Learned counsel for the petitioner<\/p>\n<p>                     submits that since the complainant failed to make payment of<\/p>\n<p>                     balance amount within time, the petitioner was not under obligation<\/p>\n<p>                     to execute the sale deed. He also submits that the dispute, if any, is<\/p>\n<p>                     essentially of a civil nature.\n<\/p>\n<p>                                  Taking into consideration the nature of accusation, let<\/p>\n<p>                     the petitioner, namely, Parvesh Kumar Sinha in the event of his<\/p>\n<p>                     arrest or surrender before the court below within a period of four<\/p>\n<p>                     weeks from the date of receipt\/communication of the order, be<\/p>\n<p>                     released on bail on furnishing bail bonds of Rs.5,000\/- (five<\/p>\n<p>                     thousand) with two sureties of the like amount each to the<\/p>\n<p>                     satisfaction of Smt. Niharika, J.M., Ist Class, Gaya in connection<\/p>\n<p>                     with Complaint Case No.70 of 2008, Trial No.289 of 2010 subject<\/p>\n<p>                     to the conditions as laid down under section 438(2) of the Code of<\/p>\n<p>                     Criminal Procedure.\n<\/p>\n<\/p>\n<pre>Md.S.
