      The petitioner was having a regular permit to operate on the<\/p>\n
route Kottayam-Bandukka.               The route is a long distance inter<\/p>\n
district route traversing a distance of more than 500 kilometers.<\/p>\n
The permit was valid till 11.9.2006. The petitioner had submitted<\/p>\n
an application for renewal of the permit for a further period of five<\/p>\n
years, under Section 81 of the Kerala Motor Vehicles Act, 1988.<\/p>\n
However, the application for renewal submitted by the petitioner<\/p>\n
was rejected on the ground that the length of the route exceeded<\/p>\n
140 kilometers.       The petitioner challenged the rejection order<\/p>\n
before the State Transport Appellate Tribunal.                            The appeal was<\/p>\n
allowed and the first respondent was directed to renew the permit,<\/p>\n
to operate as a higher class of service provided the vehicle offered<\/p>\n
by the petitioner was fit for such                   operation.          Accordingly, the<\/p>\n
petitioner modified his application and sought renewal of the<\/p>\n
permit to operate the service as a ‘Super Deluxe’. However, the<\/p>\n
application was again rejected. But, on appeal, the said order was<\/p>\n
also set aside by Ext.P3 judgment of the State Transport Appellate<\/p>\n
Tribunal.\n<\/p>\n

      2. According to the petitioner, the petitioner has purchased a<\/p>\n
brand new stage carriage.       He has also been issued with a<\/p>\n
temporary permit to operate on the route. However, his application<\/p>\n
for regular permit is still pending consideration of the first<\/p>\n
respondent.     Therefore, he prays for necessary directions to<\/p>\n
consider and dispose of the same expeditiously.<\/p>\n
      3. I have heard the Govt. Pleader also. He has submitted that<\/p>\n
the application of the petitioner will be considered in the next<\/p>\n
meeting of the first respondent. Though there is a meeting of the<\/p>\n
first respondent scheduled on 18.2.2010, it is submitted that it is<\/p>\n
not possible to consider the case of the petitioner on the said date.<\/p>\n
      4. In the above circumstances this writ petition is disposed of<\/p>\n
directing the first respondent to consider the application of the<\/p>\n
petitioner for regular permit to operate on the route Kottayam-<\/p>\n
Bandukka by placing the same before the next meeting of the first<\/p>\n
respondent in accordance with law, as expeditiously as possible and<\/p>\n
at any rate within a period of two months from the date of receipt<\/p>\n
of a copy of this judgment.<\/p>\n
