Mehta, learned counsel for the respondents, has tendered before us a copy of the office note dated 22nd October, 1997, issued by the Deputy Commissioner of Customs, Mumbai, which reads as follows :-\n<\/p>\n<p>  &#8220;The imports made by M\/s. Trilokya Networks Pvt. Ltd. and M\/s. E.I.D. Parry Ltd. and bonded under section 59 of the Customs Act in C.W.C. warehouse as per details given in the Annexure are allowed ex-bond clearance under DEEC as the said goods were bonded prior to the issue of the Office Note dated 24.7.1997.&#8221;\n<\/p>\n<p> 2. In view of the above, the controversy in this petition has become academic for the time being and therefore the petitioners do not want to press this petition.
