Ltd.                   ...Appellant(s)\n\n                                         Versus\n\nHarbhajan Lal                                            ...Respondent(s)\n\nWith Civil Appeal Nos.3198 of 2005, 3612 of 2005, 5644 of 2006, 3249 of 2003, 3250 of\n2003, 3251 of 2003, 3252 of 2003, 6267 of 2003, 5554 of 2004 and 7656 of 2004\n\n                                       O R D E R\n<\/pre>\n<p>Civil Appeal No.3612 of 2005:\n<\/p>\n<p>           Heard learned counsel for the parties.\n<\/p>\n<p>           The District Consumer Disputes Redressal Forum [for short, &#8220;District<br \/>\nForum&#8221;] dismissed the complaint on the ground that the driving licence was a forged<br \/>\none. In view of this finding, the District Forum came to the conclusion that as there<br \/>\nwas no deficiency in service, the complaint was fit to be dismissed and the same was,<br \/>\naccordingly, dismissed. Against the said order, when the matter was taken to the<br \/>\nState Consumer Disputes Redressal Commission [for short, &#8220;State Commission&#8221;] in<br \/>\nappeal, the order was reversed by placing reliance upon the judgement rendered by<br \/>\nthis court in the case of <a href=\"\/doc\/1827019\/\">National Insurance Company Limited vs. Swaran Singh &amp;<br \/>\nOrs.<\/a> [2004 (3) S.C.C.297], which order has been confirmed in revision by the National<br \/>\nConsumer Disputes Redressal Commission [for short, &#8220;National Commission&#8217;].<br \/>\nHence, this appeal by special leave.\n<\/p>\n<p>                                                                                &#8230;.2\/-\n<\/p>\n<p><span class=\"hidden_text\">                                          -2-<\/span><\/p>\n<p>           Learned counsel appearing on behalf of the appellant submitted that the<br \/>\njudgment rendered by this Court in the case of Swaran Singh (supra) was applicable<br \/>\nonly in relation to the case of third party. In the present case, no complaint was filed<br \/>\nby third party but the complaint was filed by the insured. Learned counsel appearing<br \/>\non behalf of the appellant stated that it has been clarified by this Court in the case of<br \/>\n<a href=\"\/doc\/1785523\/\">National Insurance Company Limited vs. Laxmi Narain Dhut<\/a> [2007 (3) S.C.C.700)<br \/>\nthat the ratio laid down in the case of Swaran Singh (supra) would apply only in<br \/>\nrelation to the cases of third party and not in relation to the own damaged cases, in<br \/>\nwhich eventuality the insurer is only liable to show that the licence was fake one.\n<\/p>\n<p>           Accordingly, the appeal is allowed, impugned orders rendered by the State<br \/>\nCommission and the National Commission are set aside and the same passed by the<br \/>\nDistrict Forum dismissing the complaint is restored.<br \/>\nCivil Appeal Nos.3249 of 2003, 3250 of 2003, 3251 of 2003 and 3252 of 2003:\n<\/p>\n<blockquote><p>           Perused the records.\n<\/p><\/blockquote>\n<blockquote><p>           We do not find any ground to interfere with the impugned orders.<br \/>\n           The civil appeals are, accordingly, dismissed.<br \/>\n           No costs.\n<\/p><\/blockquote>\n<p>Civil Appeal No.3198 of 2005:\n<\/p>\n<p>           Heard learned counsel appearing on behalf of the parties.<br \/>\n           In the facts and circumstances of the case, we are not inclined to interfere<br \/>\nwith the impugned order.\n<\/p>\n<p>           The civil appeal is, accordingly, dismissed.\n<\/p>\n<p>                                                                                      &#8230;.3\/-\n<\/p>\n<p><span class=\"hidden_text\">                                            -3-<\/span><\/p>\n<p>Civil Appeal No.5644 of 2005:\n<\/p>\n<blockquote><p>             Heard learned counsel appearing on behalf of the appellant.<br \/>\n             We do not find any ground to interfere with the impugned order.<br \/>\n             The civil appeal is, accordingly, dismissed.\n<\/p><\/blockquote>\n<p>Civil Appeal No.3501 of 2004:\n<\/p>\n<p>             Heard learned counsel appearing on behalf of the appellant.<br \/>\n             In spite of service of notice, nobody has entered appearance to contest the<br \/>\nprayer made in this appeal.\n<\/p>\n<p>             In the present case, the District Consumer Disputes Redressal Forum [for<br \/>\nshort, &#8220;District Forum&#8221;] allowed the complaint but when the matter was taken in<br \/>\nappeal, the same was reversed and the complaint was dismissed. Against the order of<br \/>\nthe Appellate Authority, a revision was filed before the National Consumer Disputes<br \/>\nRedressal Commission [for short, &#8220;National Commission&#8217;], which though has<br \/>\nrecorded a finding categorically that the licence of the driver employed by the insured<br \/>\nwas fake one but there was nothing to show that this fact was within the knowledge of<br \/>\nthe insured. Hence, this appeal by special leave.\n<\/p>\n<p>             In our view, the point involved in the present case is squarely covered by a<br \/>\ndecision of this Court in the case of <a href=\"\/doc\/1785523\/\">National Insurance Company Limited vs. Laxmi<br \/>\nNarain Dhut<\/a> [2007 (3) S.C.C.700), in which it has been laid down that no sooner the<br \/>\ninsurer is able to prove that the licence was fake one, the insurer is absolved from its<br \/>\nliability.\n<\/p>\n<p>             This being the position, we are of the view that the National Commission<br \/>\nwas not justified in allowing the revision application.\n<\/p>\n<p>                                                                                    &#8230;4\/-\n<\/p>\n<p><span class=\"hidden_text\">                                         -4-<\/span><\/p>\n<p>          Accordingly, the appeal is allowed, impugned order rendered by the<br \/>\nNational Commission is set aside and the same passed by the State Consumer<br \/>\nDisputes Redressal Commission is restored.\n<\/p>\n<p>Civil Appeal No.6267 of 2003:\n<\/p>\n<blockquote><p>          Heard learned counsel appearing on behalf of the appellant.<br \/>\n          We do not find any ground to interfere with the impugned order.<br \/>\n          The civil appeal is, accordingly, dismissed.<br \/>\n          No costs.\n<\/p><\/blockquote>\n<p>Civil Appeal No.5554 of 2004:\n<\/p>\n<blockquote><p>          Perused the records.\n<\/p><\/blockquote>\n<blockquote><p>          We do not find any ground to interfere with the impugned order.<br \/>\n          The civil appeal is, accordingly, dismissed.<br \/>\n          No costs.\n<\/p><\/blockquote>\n<p>Civil Appeal No.7656 of 2004:\n<\/p>\n<blockquote><p>          Heard learned counsel appearing on behalf of the parties.<br \/>\n          We do not find any ground to interfere with the impugned order.<br \/>\n          The civil appeal is, accordingly, dismissed.<br \/>\n          No costs.\n<\/p><\/blockquote>\n<blockquote><p>                                                                        &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p><\/blockquote>\n<blockquote><p>                                               [B.N.
